Our response comments are in bold. General Comments The issues listed below must be addressed before NCFMP can continue the review of your request. 1. Note that effective February 20, 2015, the FEMA revised the fee schedule for reviewing and processing requests for conditional and final modifications to published flood information and maps. A copy of the notice summarizing the current fee schedule, which was published in the Federal Register, can be found at https://www.fema.gov/flood-maps/change-your-flood-zone/status/flood-map-related-fees. In accordance with this schedule, the fee for your request is $6,750 and must be submitted before we can continue processing your request. Payment of this fee must be made in the form of a check or money order, payable in U.S. funds to the National Flood Insurance Program, or a credit card payment (Visa or MasterCard only). For identification purposes, the case number referenced above must be included on the check or money order. The FEMA Payment Information Form, which can be found at https://www.fema.gov/sites/default/files/2020- 09/fema_flood-maps_payment-information-form_2019.pdf, is to accompany the payment. MT-2 Form 1 was not signed by the applicant. In addition to Unincorporated Areas of Union County, it appears that the Town of Indian Trail is impacted by the project. Please submit a MT-2 Form 1 signed by the applicant and separate MT-2 Form 1 for the Town of Indian Trail. creating experiences through experience 2905 Meridian Parkway, Durham, NC 27713 / 919. 361. 5000 'JI MCADAMS RESPONSE TO COMMENTS > KLP-19000 McAdams Response: Both Union County and Indian Trail have signed the attached MT-2 forms. 3. The CLOMR request will be processed by FEMA only after FEMA receives documentation from the requestor that demonstrates compliance with the Endangered Species Act (ESA). For projects that are not constructed, funded, or permitted by a federal agency, the requestor must demonstrate ESA compliance by submitting to FEMA written justification that a "Take," meaning to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct, will not occur to threatened and endangered species present in the county as a result of the project. If a project has the potential to "Take" listed species, an Incidental Take Permit may be submitted with justification that the project is the subject, or is covered by the subject, of the permit. For projects with federal construction, funding, or permitting, a "not likely to adversely affect" determination from the Services, a "No Effect" determination from the federal action agency, or other approval from the Services is acceptable documentation of ESA compliance. The following comments are regarding the topographic workmap (p. 51 of the submittal package): a. Please resubmit a certified copy of the workmap that is signed and dated by a professional engineer. McAdams Response: A revised, signed and sealed copy of the work map has been submitted for review. b. Contour lines should be labeled, and a vertical datum is required. McAdams Response: Noted c. Update the final workmap to show the effective, corrected effective, and proposed conditions mapping on the same map so that a comparison of changes can be made. McAdams Response: Noted The following supporting files do not appear to be included with the CLOMR submittal. These files are requested in order for the technical review to be completed: Design drawings for the proposed culvert and road crossing that are certified by a professional engineer. McAdams Response: Proposed culvert and road crossing drawings have been included with this submittal. b. Digital mapping files (GIS, CAD, etc.) for the corrected effective and proposed conditions models. McAdams Response: The .SHP files for corrected effective and proposed conditions models have been included. creating experiences through experience 2 of 3 'JI MCADAMS RESPONSE TO COMMENTS > KLP-19000 6. The following issues were observed as part of the initial review of the HEC-RAS model. Upon receipt of the design plans (Comment 5a.) a technical review will be conducted, which may result in additional comments. a. When loading the model into HEC-RAS, a message states that the .g04, .g02, .g05, and .g06 files were not found. Please clean any erroneous files from the model folder and resubmit. McAdams Response: Erroneous files have been removed from the model. b. A surcharge of 1.08-ft was observed at cross section 26451.54 in the corrected effective model. All surcharge values should fall within the range of 0.0-ft to 1.0-ft. McAdams Response: After correcting the encroachment stations and other errors present in model the surcharge has been adjusted so that it is less than 1.0ft. c. In the corrected effective model, the right encroachment station at cross section 26451.54 is not contained within the 100-year water surface elevation (WSEL). The review also found that encroachment stations fall outside the 100-year WSEL at cross sections 26451.54 and 26406 in the proposed conditions. Encroachments should be adjusted to ensure they fall within the 100-year WSEL. McAdams Response: Noted. The encroachment stations have been adjusted to fall within the 100-yr WSEL.
