Box 550*Newton, N.C. 28658*(828) 695-4300 May 17, 2021 Wes Bell Division of Water Resources 610 East Center Ave. Ste. 301 Mooresville, NC 28115 Subject: Notice of Violation/Failure to properly Implement Pretreatment Program PAR Review City of Newton NPDES Permit No. NC 0036196 Catawba County Tracking No. NOV-2021-PC-0284 Dear Mr. Bell, In response to the Notice of Violation (NOV) that was issued to the City of Newton for failure to implement the Pretreatment Program; the SNC for Special Metals came at a time during which the City of Newton was on a rotating schedule due to Covid-19 Pandemic. The Pretreatment Coordinator did catch the violation and did the proper procedures to correct it. The PAR was updated with all corrected information and the copies required for those corrections. We feel that since this was caught and corrected by the Pretreatment Coordinator, the City of Newton should not receive monetary fines and that the City of Newton should not be issued a Notice of Violation (NOV). The Covid-19 restrictions have been lifted and the City of Newton is back in full swing. In the future, we will be using a calendar reminder for all pertinent information regarding sampling and results so this does not happen again. The City of Newton is determined to stay in compliance with State and Federal guidelines as well as the SUO for the City of Newton and the NPDES permit.
