Dear Mr. Grant:
On February 20, 2013 Roberto Scheller of the Division of Water Quality (DWQ) was on -site at the Lee Complex to assist in collection
of surface water samples with the NDES group. While on -site a cursory review of permitted sites was conducted for a Compliance
Evaluation Inspection (CEI) of 401 permitted sites at the H. F. Lee Energy Complex. Specifically NPDES outfall #3, located on
Neuse River, was reviewed. It was noted that erosion of the riverbank had occurred and the rip -rap lined energy dissipation ditch was
failing. This Office investigated using modification of the existing 401 permit (DWQ# 06 -0638 Ver. 3) to conduct repairs. This
Office was advised from our Raleigh Central Office that a new permit application would be necessary for repairs to the subject outfall.
Therefore, it will be necessary to submit a new PCN application form with associated plans and drawings.
At time of inspection the subject project appeared to be compliant with the General Certification #3687. It was noted that discharge
flow from outfall #3 is being diverted into holding ponds until repairs are completed. If you have any questions or require assistance
in the 401 permitting process please call Roberto Scheller in the Washington Regional Office at (252) 948 -3940. Please note that this
letter is to report findings of a Compliance Evaluation Inspection (CEI) and does not authorize any impacts to either Waters of the
United States or Waters of the State. Please contact the US Army Corps of Engineers (USACE) or NC Division of Water Quality
(DWQ) if any additional impacts are proposed.
