Maintain all basins examined during the inspection (ID 15.5, the breached pond, 15.4, HB 1, 27.4, and 27.3; may not be all inclusive). For all affected basins, the front bays should be mucked out, baffles installed, re-installed, or replaced. The skimmers shall be checked for function or sizing as none appeared to be dewatering. The surrounding slopes shall be stabilized,weir and spillway fabric secured,and dissipation pads installed per plan. 2. Ensure that all temporary diversions flow into retention devices. Construction stormwater is bypassing HB 1 (currently being used as a sediment basin). A few areas of sediment loss 3. were observed, most notably in the jurisdictional stream between HB 1 and basin 15.4, and behind SSCF outlets along Y16RPA, between basin 27.3 and the -L- intersection. These also lead to the jurisdictional stream. Any areas of loss occurring behind silt fence, SSCF outlets,or outside LODs in general need to be removed immediately. Any areas previously matted or seeded/strawed that contain lost sediment need to have lost sediment removed, and the areas re-stabilized. Removed sediment should be stockpiled or graded onto areas at least 50 feet from surface waters and stabilized. 4. Review and evaluate the turbidity curtain installed in the private pond. A qualified individual should evaluate and ensure the type,proper installation, and maintenance of the turbidity curtain for the private pond. 5. Remove the sediment discharges to the private pond. Permission from the landowner must be obtained prior to initiating cleanup activities. Additional restoration activities may be required to restore the pond to a natural stable condition when sediment removal activities have been completed. Approval of clean up and restoration activities in the pond must also be obtained from DWR. 6. Provide assurances that erosion control measures are/were based on Design Standards for Sensitive Watersheds where required throughout the project as this site is in High Quality Waters. 10. Comments: On April 27, 2021,Kimberly Turney and Tyler Pearson of the North Carolina Department of Environmental Quality Division of Energy,Mineral, and Land Resources (DEMLR)Winston Salem Regional Office conducted an on-site inspection of NCDOT Project TIP U 3109 (Mebane Bypass), in Alamance County. The site was inspected due to a complaint by the owner of a private pond in the vicinity of the project between L Sta 160+00 and Sta 165+00. The owner stated his pond has grown increasingly murky since the beginning of the project. He further stated the turbidity curtain installed in the pond has broken free at least twice(he allowed the use of his personal boat to assist in its reattachment/reinstallation), and that no efforts to clean collected sediment or to address the condition of the pond has been made thus far. The private pond appeared highly turbid and opaque. The mouth of the pond in front of the turbidity curtain, with the exception of the visible collected sediment to the left and right of the pipe, is currently clear. This is consistent with the acknowledged use of polyacrylamide (PAM) on upstream measures mixing with the suspended solids/aggregates until reaching the turbidity curtain and settling. Project representatives acknowledged that the turbidity curtain has broken free twice. It is unknown how much accumulation had occurred at the mouth of the pond prior to its failure both times, and therefore unknown how much sediment loss has actually occurred. Turbidity in the pond is significant enough to have caused downstream deposition of sediment from the riser outlet of the dam into the stream below. NPDES records maintained by the contractor and ESS reports from NCDOT Roadside Environmental Unit from approximately November, 2020 to March, 2021 were reviewed; NPDES records were listed as not reviewed on ESS reports during this time. The closest rainfall events prior to the inspection occurred on 4/14/2021 in the amount of 1/8", and 3/31/3031 in the amount of 1/2". The NPDES reports documented needed repairs to the turbidity curtain and sediment loss into jurisdictional streams (JS) in areas upgradient of the pond,as well as other losses of sediment outside limits of disturbance(LOD). Losses were not reported as is required to either the Division of Energy,Mineral,and Sedimentation/Construction Stormwater Inspection Report North Carolina Department of Environmental Quality Land Resources: 450 W. Dave Wanucha with the Division of Water Resources Winston Salem Region Office visited the site on April 27,2021 and requested turbidity testing of the private pond.
