On Junc 12, 2007, the Division of Water Quality (DWQ) 401 i:?versight/Expres,51'errtritting Unit received
your complete minor variance application dated Jut1e 5, 2007, regarding your request for a Minor
Variattcc from the Neuse BuB'er Rules {I SA NCAC 2B .0233) for the subject property. The DWQ is
required to prepare a `~trelimi>1ary fmding"/"#ittdiptg of fact' as tv whether the variance request meetc the
requiretncrrts of 15A NCAC 02B .0259(9xa). The DWQ may attach conditions to a variance approval
that support the purpose, spirit and intent of the riparian buffer protection program. Conditions usually
include stormwatcr management and buffermitig~tion.
Additional information will be required before we can proceed with ~ review ofyour variance request.

denial of your request per 15A NCAC 2B .0233 and will pace this project on hold as inconapletl: until we
receive this additional information.

1. Buffer NlitiQation -Mitigation wit! be tegt,ired as a condition if you ehoosc to proceed with either
the Minor ~ Majos Variance, lfyou choose to proceed with a variance, then please provide a
buffer mitigation plan pursuant to 1 SA NCAC 02H .0242. If you plan to use the Riparian Buffer
Restoration Fund administered by the NC Ecosystem Enhanecmcnt Program t;EEP) for your
required buffer mitig~on omits, please provide an EEP acceptance letter for the requited
credits.
2. Planting Plan -Please provide a planting pleb,, including a map showing the bcations of the
individual trees that will be planted and the area that will be grassed (please inchade the type of
grass seed that will be used). Please include the footprint of the Douse tbat will be built on the
sitcand note on your planting plan when (and i fl your one-time fertil iration will occur.
