The plant currently has a permit to discharge 0.84 MGD of treated domestic and industrial wastewater to Densons Creek in the Yadkin - Pee Dee River Basin in Montgomery County. You requested speculative limits at 1.2 MGD. In addition, the NPDES Unit has received the Town's renewal application for the 0.84 MGD flow, dated August 24, 1998. The current permit expires June 30, 1999. We have reviewed the request and provide the following response with the enclosed speculative limits. The speculative limits presented here are based on our understanding of the proposal and of present environmental conditions. The Division of Water Quality (DWQ) cannot guarantee that it will issue the Town an NPDES permit to expand its discharge of treated wastewater into waters of the State. Nor can we guarantee that the effluent limitations and other requirements included in any permit will be exactly as presented here. Final decisions on these matters will be made only after the Division evaluates a formal permit application for the Town's discharge and notices the proposal for public comment. Environmental Assessments of New Projects and Expansions Please be aware that you will have to evaluate this project for environmental impacts before applying for a permit modification. Anyone proposing to construct new or expanded waste treatment facilities using public funds or public (state) lands must first prepare an environmental assessment (EA) when wastewater flows (1) equal or exceed 0.5 MGD or (2) exceed one-third of the 7Q10 flow of the receiving stream. DWQ will not accept a permit application for a project requiring an environmental assessment until the Division has approved the EA and sent a Finding of No Significant Impact (FONSI) to the state Clearinghouse for review and comment. Town of Troy Page 2 of 3 The current situation with the Town's treatment system is unusual in that the majority of treatment units are currently sized to treat the requested 1.2 MGD effluent flow. Per your discussions with Ms. Susan Wilson, the only treatment unit not sized to treat the 1.2 MGD flow is the disinfection unit. Due to an oversight by the Division, speculative limits for 1.2 MGD effluent flow were not given at the time of request for an Authorization to Construct permit to update the previous treatment system. Speculative Effluent Limits Based on the available information, tentative limits for the proposed discharge of 1.2 MGD flow to Densons Creek are attached. The speculative limits are explained below. - Flow Limits. The flow will be limited to 1.2 MGD requested by ,the Town. This limit will be applied as a monthly average. BOD5 and NH3-N. The summer limits of 7 mg/1 (BODS) and 2 mg/1 (NH3-N) for these parameters were based on the waste assimilating capacity of the receiving stream at low flow conditions for this size facility. This is a reduction from the previous summer limits of 13 & 2 at the 0.84 MGD permitted flow. The winter limits of 14 mg/1 (BODS) and 4 mg/1 (NH3-N) are reduced from the previous winter limits of 26 & 4 at the 0.84 MGD permitted flow. TSS. The limits for total suspended solids are standard for secondary treatment of municipal wastewater. Fecal Coliform, pH. The limits for fecal coliform bacteria and pH are derived to protect water quality in the receiving stream and remain the same as in the previous permit. Chlorine. The Division requires chlorine limits and dechlorination for all new or expanding dischargers proposing the use of chlorine for disinfection. The process of chlorination/ dechlorination, or an alternate form of disinfection such as ultraviolet radiation, should allow the facility to comply with the total residual chlorine limit. Receiving Stream Flow: The Division has received updated flow estimates for Densons Creek [confirmed via letter from Curtis Weaver, USGS Hydrologist, June 9, 19991. The new low flow estimate for the Town's discharge point, based on a drainage area of approximately 32 square miles was found to be 0.35 cfs (summer 7Q10). The limits at 1.2 MGD were based on these new flow estimates. Previous USGS flow estimates indicated a summer 7Q10 flow estimate of 0.1 cfs. The increased low flow estimate provided greater assimilative capacity in the receiving stream. Another result of the greater stream flow would be a decrease in the instream waste concentration (or the percentage of the receiving stream that is effluent flow). Chronic Toxicity Testing: The Town's chronic toxicity limit for the 1.2 MGD flow will be Pass/Fail at 84%. The toxicity testing requirement will be lower based on the decreased instream waste concentration at the newly estimated 7Q10 flow of 0.35 cfs. Upon renewal of the permit the chronic toxicity testing requirement for the existing permitted flow of 0.84 MGD will be modified to 79%. Toxicant Parameters: Estimation of toxicant parameters will not be given with this speculative letter, but will be submitted as appropriate with the draft NPDES permit. Mr. Gray Walls, P.E. Permit No. NC0028916 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (ORTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 84 %. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised - February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Branch 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must`be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failur: adhieve test conditions as specified in the cited document, such as minimum -control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than Inc iast aay w we month following the month of the initial monitoring. Decant from the tank will be sent to the influent pump station just as is now being done. Aeration will be used for odor control. This plant operations change will eliminate waste sludge pumping and storage in the secondary lagoon. This should create a more efficient sludge pump and haul operation when land application of sludge is done. It is noted here that the 503 Sludge Treatment Requirements are being met by the existing sludge digester. As far as sludge treatment is concerned no changes are proposed. In writing this memo, the Town seeks to confirm from your office that an Authorization to Constructis not necessary for this operational change. MANAGEMENT FAYET EVILLE REG. OFFICE The Town of Troy has a manhole at the intersection of Perry St. and Reynolds St. that overflowed on 04/13/95 and on 04/14/95. This manhole is between 18" and 24" deep. The 04/13/95 overflow was due to a heavy rainfall event. The 04/14/95 overflow was due to a blockage in the line. The manhole is in a section of line that drains the South side of Troy and contains some of the oldest sewer collection piping in Troy. This section of line experiences inflow and infiltration problems no better or worse than the rest of our system but hydraulically this particular section of line and manhole in particular have been "engineered" incorrectly. We analyzed this section of the collection system all the way to Bilhen pump station and found that flow diversion in another direction was the only solution to completely alleviate this overflow problem. Flow diversion can be accomplished by re-routing the sewer collection line at the end of Perry Street over to Smith Street pump station and re -working the Smith Street pump station so that instead of pumping 100 GPM at 40 TDH, the station will pump 325 GPM at 105 TDH. All the pump and electrical equipment necessary to complete this upgrade have already been purchased and are stored at the public works building. A large amount of flow from the South side of Troy will be diverted into this pump station and 3500 LF of new force main will be constructed through the South side of Troy up to 24-27 East. At that point, approximately 2500 LF of new 15" gravity outfall line will be constructed down to Broughton Street. This outfall line flows directly into Troy's WWTP. Plans and specifications have already been approved for these modifications and the Project had been bid once. Due to a misunderstanding with the low bid Contractor beyond Troy's control the Project was delayed to allow time for project re -bid. During this time period an industry proposed to locate on the West side of Troy and an EDA grant that included funding for this Project summarized above was submitted to EDA. Troy has been assured that funding of this project is almost a certainty therefore awaiting formal f notification seems to be the only prudent course of action. Spending any money prior to this notification would result in the loss of all moneys expended prior to formal notification. Troy has been informed that formal notification should be received within the next 60 days. This would put project funding notification on or before June 15, 1995. Once this occurs it is the intent of the Town of Troy to commence work immediately on this Project. Construction time for the Project is projected to be approximately 3 to 6 months. Using this time table, the flow diversion should be completed by no later than December 31, 1995. Once this Project is completed, the amount of flow entering the manhole on Perry Street will be cut to almost nothing. The length of sewer collection pipe draining into this manhole will be less than 2000 LF. Since the pipe in this section is newer pipe inflow and infiltration should be at a minimum. Until the Project is completed, any overflows that occur will be immediately cleaned up and lime will be spread to disinfect the contaminated area. Any option to speed up the time table beyond what has been stated above will certainly be evaluated and utilized if feasible. PURPOSE OF NOTICE This Notice is intended to meet two separate procedural requirements of 24 CFR Part 58: (1) To provide notice to the public that the Town of Troy has determined that the request for release of funds for the above named project will not have a significant impact on the environment; (2) To provide notice to the public that the Town of Troy is requesting the release of funds for the above named project. FINDING OF NO SIGNIFICANT IMPACT It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above named Town has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190). The reasons for such decision not to prepare such Statement are as follows: The proposed project is in compliance with all applicable statutory laws and regulations and long-term beneficial impacts far outweigh short term adverse impacts. Short term adverse impacts include increases in noise, dust and traffic caused by project construction activities. Long term beneficial impacts include elimination of slum and blighted conditions, provision of standard housing conditions, and restoration of the neighborhood to long-term viable condition. An Environmental Review Record respecting the within project has been made by the above named Town which documents the environmental review of the project and more fully sets forth the reasons why such statement is not required. This Environmental Review Record is on file at the Town Manager's Office at the Troy Town Hall and is available for public examination and copying upon request at the Town Hall between the hours of 8:00 a.m. and 5:00 p.m. No further environmental review of such project is proposed to be conducted prior to the request for release of Federal funds. PUBLIC COMMENTS ON FINDING All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the Town of Troy to the Manager, Town of Troy, 444 N. Main Street, Troy, NC 27371. Such written comments should be received at the address specified on or before January 27, 1994. All such comments so received will be considered and the Town will not request the release of Federal funds or take any administrative action on the within project prior to the date specified in the preceding sentence. RELEASE OF FUNDS The Town of Troy will undertake the project described above with Community Development Block Grant funds from the North Carolina Department of Commerce under Title I of the Housing and Community Development Act of 1974. The Town of Troy is certifying to DOC that the Town and Roy Manness, in his official capacity as Mayor of the Town of Troy, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making and action; and that these responsibilities have been satisfied. The legal effect of the certification is, that upon its approval, the Town of Troy may use the Community Development Block Grant funds and DOC will have satisfied its responsibilities under the National Environmental Policy Act of 1969. OBJECTIONS TO STATE RELEASE OF FUNDS DOC will accept an objection to its approval only if it is on one of the following bases: (a) that the certification was not in fact executed by the certifying officer or other officer of applicant approved by DOC; or (b) that applicant's Environmental Review Record for the project indicates omission of a required decision, finding or step applicable to the project in the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to NCDOC - Division of Community Assistance, P.O. Box 12600, Raleigh, North Carolina 27605-2600. Objections to the release of funds on bases other than those stated above will not be considered by DOC.
