PROJECT SUMMARY: The applicant proposes the construction of a private 7-slip community dock into Whiskey Creek, which would accommodate 22 new lots within the Masonborough Plantation at Whiskey Creek subdivision. PROJECT DESCRIPTION: The project site is located at 8113-8115 Masonboro Sound Road, adjacent to Whiskey Creek, in the City of Wilmington, New Hanover County. To locate the property traveling south on College Road, take a left onto Mohican Trail and travel approximately 1.3 miles. Turn left onto Masonboro Loop Road and travel north approximately 1 mile. Turn right onto Masonboro Sound Road and travel east for approximately 0.1 miles and take the first right past Mason Knoll Subdivision into the new Masonborough Plantation Subdivision. Travel south onto Donnelly Lane until the new road terminates into a cul-de-sac at a point overlooking Whiskey Creek. Existing structures on the property includes new utilities and roads. The property has approximately 325' of shoreline and averages approximately 15' above mean sea level. Highground vegetation of this tract consists of grasses and shrubbery. Other upland vegetation includes mixed hardwoods and other species including: Oak, Dogwood, Maple, Magnolia and Pine. Waterward of the upland vegetation is an area of high marsh approximately 30' in width consisting of mixed coastal wetlands and "404" type vegetation including Marsh Elder (Iva frutescens), Grounsel-bush (Baccharus halimifolia), Sea Oxeye (Borrichia frutescens) and Salt Meadow Grass (Spartina patens). The property transitions from high marsh to low marsh in an area approximately 15-20' in width to Whiskey Creek consisting primarily of Smooth Cordgrass (Spartina alterniflora). Waterward of the low marsh are several areas of oyster reefs visible in the mud flat at low water. In the project area, the waters of Whiskey Creek are classified as SA by the NC Division of Water Quality, and they are CLOSED to the harvest of shellfish. These waters are designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The applicant submitted a CAMA Major Permit application last year on 6/8/06 for an 8-slip community dock for the new Masonborough Plantation Subdivision. The applicant modified the application on 8/31/06 and again on 12/15/06 to address the concerns from interested review agencies due to the limited amount of water at low tide in the location of the proposed slips. The modified application included a hydrographic survey to address the discrepancy over the water depths included in the original submittal. The modified location and design of the proposed boatlifts addressed the concerns of the interested review agencies, but also placed the community dock beyond the 1/3 distance within the waterbody. The application was denied based on this inconsistency. The applicant then submitted a variance request to the Coastal Resources Commission (CRC). At the May 2007 CRC meeting in Greenville, the CRC denied the variance to Generation Builders, Inc. of New Hanover County, who sought relief from the commission's pier rules in order to construct an access pier and associated structures as part of a multi-slip docking facility located at the Masonborough Plantation Subdivision. The project's total length is in excess of that allowed by the commission's pier length rules. PROPOSED PROJECT: The applicant proposes the construction of a private 7-slip community dock into Whiskey Creek, which would accommodate 22 new lots within the Masonborough Plantation at Whiskey Creek Subdivision. The application states that this is a re-submittal of the project that was recently denied for the 8-slip community dock. The 11.92- acre tract is approximately 1500 feet in depth from Masonboro Sound Road to Whiskey Creek and averages approximately 335 feet in width. The tract of land is subdivided into 22 lots of approximately 0.34 acres each. Donnelly Lane is placed on the central portion of the tract that terminates to four lots (Lots 11-15) on the point overlooking Whiskey Creek. Lot 11 is located on the western side and Lot 15 is located on the eastern side of the point. The applicant proposes to have a 10' in width community easement between Lots 12 and 13, which would be the location of the proposed community private pier. A platform 16' in length by 8' in width would be constructed at the end of the easement, which would be entirely over high ground. An access pier would begin in a southeasterly direction for approximately 20' in length and then turn in a southerly direction for a distance of approximately 153' in length into Whiskey Creek. There would be octagonal gazebo with a 20' span connected to the eastern side of the proposed pier, which would be approximately 120' waterward of Normal High Water (NHW). The pier would terminate in a 72' in length by 5' in width "T-head" platform. Four (4) finger piers each measuring 24' in length by 3' in width would be installed, which would extend from the "T-head" platform perpendicular to the shoreline. The application states that the boatlifts would be located approximately at the -1' @ Mean Low Water (MLW) contour according the hydrographic survey. The application also states that the boatlifts would be designed to operate at water depths of -2' @ NLW or greater to satisfy the concerns of the interested review agencies (See Project Narrative and Sheet 3 of 6). 10. ANTICIPATED IlVIPACTS: The proposed upland development for the subdivision would not be located within the 75' Estuarine Shoreline AEC. The proposed community dock would incorporate approximately 1,888 sq. ft. of Estuarine Shoreline, Public Trust Area and Estuarine Waters. Approximately 128 sq. ft. of Estuarine Shoreline would be impacted for the platform. Approximately 450 sq. ft. of Coastal Wetlands would be impacted due to shading. Minor increases in turbidity should be expected during construction. The proposed structures would extend approximately 150' into a waterbody, which measures approximately 455 feet across on the eastern end and approximately 481' across on the western end of the proposed structures. This distance would conform with rule 7H.208 (b)(6)(J)(iii), which states "The one-forth limitation shall not apply when the proposed pier is located between longer piers within 200' of the applicant's property. However, the proposed pier cannot be longer than the pier head line established by the adjacent piers, nor longer than 1/3 the width of the waterbody". The proposed structures would not encroach into the adjacent 15' Riparian Property Setback Requirement and would provide dockage for up to 7 vessels. Submitted by: Robb L.
