Hwy 601 Development, LLC, has contracted Carolina Wetland Services, Inc. (CWS) to provide Section 404/401 permitting services for this project. An executed Agent Authorization Form is attached (Attachment B). The purpose of the project is to develop the property for a single-family subdivision. USACE and NCDEQ have previously issued the 404 and 401 permits for this project. However, due to the presence of rock that would make the construction of foundations for the originally proposed bottomless culvert design both more challenging and expensive, the applicant proposes utilizing a 72" RCP culvert at this location. This would result in 108 linear feet of additional permanent impacts and 20 linear feet of temporary impacts due to the dewatering system. The project also proposes one additional open cut waterline crossing (15 If temporary impacts). The previously authorized and now completed impacts totaled 105 linear feet of permanent stream impacts as measured in May 2021 (76 If of culvert and 29 If of rip rap), 0.05 acre of permanent wetland impacts, and 40 linear feet of temporary impacts due to temporary construction access. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project area consists of an active construction site and undeveloped forest. On -site elevations range from 500-590 feet above mean sea level (Figure 2). Land cover within the project area consists of mixed forest, shrub/scrub, and woody wetlands (Figure 3). According to the United States Department of Agriculture - Natural Resources Conservation Service (USDA-NRCS) Web Soil Survey of Union County (Figure 4) and the NRCS Historic Soil Survey for Union County (Figure 5), current and historic on -site soils consist of seven different soil types (Figure 4). Of the on -site soils, none are listed on the Web Soil Survey as containing hydric inclusions. A review of the NWI GIS layer depicts one potential freshwater pond occurring on site (Figure 6). 3b. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. In order to avoid and minimize impacts to jurisdictional waters of the U.S., the Cottage Green Subdivision site was delineated prior to developing the site plan, and the proposed site plan was designed to avoid the jurisdictional features to the maximum extent practicable. On -site waters of the U.S. were delineated, and a Preliminary Jurisdictional Determination site visit occurred on April 27, 2018 (SAW-2018-00646). The configuration and density of the project has been designed to avoid waters of the U.S. to the greatest extent practicable while still meeting project goals. Originally, the project proposed only one road crossing with culvert. The second crossing was originally designed as a bottomless culvert. However, due to the presence of rock that would make the construction of foundations for the originally proposed bottomless culvert design both more challenging and expensive, the applicant proposes utilizing a 72" RCP culvert at this location. Additionally, the construction cost for the bottomless culvert has increased during the past 2.5 years from the original permit approval and the bottomless culverts also have higher maintenance costs. The proposed road crossings were designed to cross streams at a near perpendicular angle. The proposed culvert will be buried 1' below the exiting grade to facilitate the aquatic life movements. No Build Alternative To minimize impacts to jurisdictional waters while meeting the goals of the project, a "No Build" alternative was considered. The property is being purchased for the purpose of providing more residential housing to meet the growth and demand of an area in Monroe experiencing significant population growth. A "No Build" option would not meet the project goals of providing necessary housing to meet the current demand. Therefore, the No Build Alternative was eliminated from further consideration. 1 a. (CWS) to provide a protected species habitat assessment for the Oakton Subdivision Site. The Oakton Subdivision Site (Union County Tax Parcel Nos. 09125134 and 09158001) is approximately 75 acres in extent and is located southeast of the Highway 601 and East Highway 74 intersection, in Union County, North Carolina (Figure 1). Methods In -office Desktop Review To determine which protected species are listed as occurring or potentially occurring within the project vicinity and prior to conducting the on -site field investigation, CWS consulted the United States Fish and Wildlife Service (USFWS) Endangered and Threatened Species and Species of Concern by County for North Carolina online database for Union County'. In addition, CWS performed a data review using the North Carolina Natural Heritage Program (NCNHP) Data Explorer2 on March 13, 2018 to determine if any recorded occurrences of federally -listed, candidate endangered, threatened species, or critical habitats are located within the project limits. Typical habitat requirements for listed species was discerned from multiple USFWS3 and NCNHP4 online resources including, but not limited to, specific USFWS species profiles, recovery plans, NCNHP's Guide to Federally Listed Endangered and Threatened Species of North Carolina, and List of the Rare Plant Species of North Carolina. Field Survey CWS scientists Gregg Antemann, PWS, Christine Giest, PWS, Daniel Roberts, Project Scientist, Dan Zurlo, Staff Scientist II, and Megan Shelton, Staff Scientist I, conducted a pedestrian habitat assessment of the project area on March 5 and 20, 2018. Potential habitat for potentially occurring federally -protected species that was identified during the desktop review was assessed in the field for the quality of physical and/or biological features essential to the conservation of the applicable species. Additionally, during the pedestrian habitat assessment, areas were reviewed for applicable federally protected species; however, formal surveys were not conducted. Identification references for natural communities include the National Land Cover Database 2011 Legend.' Results Based on the NCNHP data explorer response, there are no current records of federally -protected species within the project limits or within a mile of the project limits (Attachment A). The USFWS lists three federally protected species for Union County (Table 1). An official species list has not been obtained from the USFWS Asheville Field Office. Table 1. These community types consist of mixed forests, woody wetlands, shrub/scrub land, and maintained open areas (Figure 3). Of the identified on -site community types, the boundaries between the mixed forests, shrub/scrub land, and maintained open areas are potential habitat for federally threatened or endangered species that could potentially occur within the project limits. A brief description of each species habitat requirements and determination of effect findings are listed below by species. Schweinitz's sunflower (Helianthus schweinitzii) Habitat Description: Schweinitz's sunflower is a perennial herb with yellow rays and yellow centers. They can reach heights of five feet. It has been listed as an Endangered species under the ESA since 1991. The typical habitat for this plant includes roadsides, old pastures, transmission line right-of-ways, open areas, either natural or human -maintained habitats, or edges of upland woods. Schweintz's occurs frequently (Over 70%) in Tatum and Herndon, both ultisols, and in Goldston, an inceptisol. Major characteristics of soils associated with suitable Schweinitz's sunflower habitat include thin soils, soils on upland interstream flats or gentle slopes, soils that are clay like in both composition and texture (and often with substantial rock fragments), soils that have a high shrinkage swell capacity, and those which vary over the course of the year from very wet to very dry'. Biological Analysis: CWS biologist conducted a pedestrian survey to transect potential on -site habitat for this species within the maintained open areas in the northeast portion of the site and shrub/scrub land in the western portion of the site (Figure 3; Photographs 1 and 2, Attachment B). The desktop review and field survey assessment determined that the maintained open areas and shrub/scrub land have the proper soils, slopes, and occasional disturbances, however, there were large amounts of invasive species such as Chinese privet (Ligustrum sinense), and Japanese honeysuckle (Lonicera japonica) in these areas. Additionally, land use history derived from Google Earth historical aerial imagery suggests these areas have been mechanically cleared and tilled, which would have reduced suitability of the habitat for species persistence. Soil types in these communities consist of mostly Badin Channery silt loam with 10 percent minor components of Goldston and Tatum. No individuals of Schweinitz's sunflower or other Helianthus species were observed during the pedestrian habitat assessment on March 5 or 20, 2018. Based on these findings, CWS concludes that supportive habitat is not present within the project area due to large amounts of invasive species, non -conducive historical land use, and no known population records of the species occurring within one mile of the project area in the NHP database. These findings lead CWS to conclude that the project will not affect Schweinitz's sunflower. Michaux's sumac (Rhus michauxii) Habitat Description: Michaux's sumac is a rhizomatous shrub. It is densely hairy with compound leaves exhibiting evenly -serrated leaflets. Flowers are small, greenish to white, in terminal clusters. Fruits are red drupes produced from August to October. It has been listed as an Endangered species under the Endangered Species Act (ESA) since 1989.9 It is found on the coastal plains of Virginia to Florida, with most populations occurring in North Carolina. Michaux's sumac prefers sandy or rocky open woods with basic soils, as well as highway right-of-ways, roadsides, or edges of artificially -maintained clearings. Biological Analysis: A NCNHP data record review revealed that there are no current occurrences for this species within the project limits, or within a one -mile radius of the project (Attachment A). Additionally, on -site soils consist of acidic silty soils that are not suitable for Michaux's sumac. Based on the desktop review and pedestrian habitat assessment, no potential habitat for Michaux's sumac is present within the project limits. No individuals of Michaux's sumac were observed during the field assessment on March 5 or 20, 2018. Therefore, due to lack of suitable habitat, the proposed project will have no effect on Michaux's sumac. Carolina heelsplitter (Lasmigona decorata) Habitat Description: The Carolina heelsplitter was historically known from several locations within the Catawba and Pee Dee River systems in North Carolina and the Pee Dee and Savannah River systems, and possibly the Saluda River system in South Carolina. In North Carolina, the species is now known to only occur within Goose Creek, the Pee Dee River system, and Waxhaw Creek in the Catawba River system. The species exists in very low abundances, usually within 6 feet of shorelines, throughout its known range. The general habitat requirements for the Carolina heelsplitter are shaded areas in large rivers to small streams, often burrowed into stable, clay banks between the root systems of trees, or in runs along steep banks with moderate current. Recently, the Carolina heelsplitter has been found in sections of streams containing bedrock with perpendicular crevices filled with sand and gravel, and with wide riparian buffers.10 Biological Analysis: A pedestrian review of potential on -site habitat for Carolina heelsplitter was conducted for Stream A during the site visit on March 5, 2018. On -site perennial Stream A contains frequent canopy gaps, moderately eroded clay banks, a weak to moderate shallow current, slightly turbid waters, and a weak bank root system of invasive shrubs (Figure 3, Photograph 3, Attachment B). Additionally, the furthest downstream portion of Stream A on the site is culverted beneath E. Old Highway 74 at the western extent of the site, limiting the biological connectivity of Stream A to downstream waters. On -site streams are not located within the Goose Creek or Waxhaw Creek watersheds. Stream A is located in the Richardson Creek watershed. Richardson Creek comes to a confluence with the Rocky River over 20 river miles upstream of Goose Creek and suitable biological connectivity of cool, clean, and clear streams from Stream A to these downstream waters does not exist. These findings lead CWS to conclude this project will have no effect on the Carolina heelsplitter. Determinations Based on the literature search and the results of the on -site assessment for suitable habitat of federally -protected endangered, threatened, and candidate species, it has been determined that suitable habitat is not present within the project limits for Schweinitz's sunflower, Michaux's sumac, or Carolina heelsplitter. The purpose of the project is to develop the property into a residential development. HWY 601 Development LLC has previously obtained 404 and 401 permits for this projects. The previous impacts included 160 linear feet of stream impacts and 0.05 acre of wetland impacts. HWY 601 Development LLC is requesting to add one additional stream crossing for a proposed road. This crossing was originally planned to be a bottomless culvert. The location of the additional crossing is shown in the attached site plan.
