Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Describe the overall project in detail, including the type of equipment to be used: The proposed project is a commercial development with permanent impacts resulting from the installation of three road crossings, two road widenings and lot fill for the necessary parking lots and retail buildings. Heavy equipment typically used for construction will be employed for this project. 10. Explain the purpose of the proposed work: The purpose of the proposed work is to supply a commercial shopping area for the new and existing residential area. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. On August 11, 2005, Mr. Eric Kulz of the DWQ Raleig~i Re ig'onal Office conducted an on-site determination for the applicability of the Neuse Buffer Rules (15 A NCAC 2B .0233) to the streams on the subject property (see attached letter, . The map sued (see attached) by Mr. Kulz also indicates the perennial and intermittent features on the subject property. S&EC completed the detailed wetland delineation for the entire site on Ju1~28, 2005. Currently, the survey map has been submitted to the USACE for si~ature and approval. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No future uermit requests are anticipated at this time. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. Impact Justification (Avoidance and Minimization) Page 5 of 10 Specifically describe measures taken to avoid the proposed impacts. It maybe useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The proposed road widening (impact #1 and #4) were necessitated by the need for turning lanes into the subject property In both cases, the Qpe extensions and resultant impacts were minimal (10 linear feet and 32 linear feet respectivelyl and will have concurrent de-watering for the pipe placement The road crossings (impact #2 and #5) were planned over intermittent/unimportant stream channels and placed perpendicular to the channel Headwalls will be used to further minimize impacts to the culvert crossing. It should be noted that Impact #2 is on anon-buffered intermittent/unimportant stream channel. Topography constraints necessitated fill in the channel in order to construct the retail building and the re uired parking lot. The proposed wetland impacts Impact #3 #5 and #6) are due to fill reauired for the retail buildings and the necessary parking lots as well a road crossing to access the middle of the property In addition a portion of the wetland associated with Impact #5 is within the Neuse River Buffer This impact is linked with the road crossing discussed above. The road crossings for Impact #7 and #8 are unnecessary however the Durham Planning Department has a requirement that states all parcels must front a public R-O-W Durham has stated that they will not require the crossings if DWO and/or the USAGE deny them For that reason, we are requesting that these crossings be denied as the.proposed road cul-de-sacs next to Interstate I-85 and serves no purpose. Additionally, the Northwestern portion of the property is not being developed and therefore no road is needed And finally, the parcel to the extreme north of the subiect property has access through the proposed road crossing enumerated in Impact #5. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Page 6 of 10 If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at htt~p•//h2o enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. For impacts to wetlands and streams navment into the NCEEP is proposed to satisfy the mitigation necessary for this project 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. Stormwater (required by DWQ) Describe impervious acreage (existing and proposed) versus total acreage on the site. Discuss stormwater controls proposed in order to protect surface waters and wetlands downstream from the property. If percent impervious surface exceeds 20%, please provide calculations demonstrating total proposed impervious level. The impervious surface for this project will be approximately 69.9% which will reauire a stormwater manas?ement plan. Attached, please find a preliminary Stormwater Management Plan for the project An appropriately sized area has been set aside for an extended detention wetland however final design has not been completed at this time. We are requesting that a conditiona1401 be issued that would reauire the submittal and approval of a Stormwater management elan before any proposed impacts take place. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. The project will tie into the City of Durham's sewer system. XIII. Violations (required by DWQ) Is this site in violation of DWQ Wetland Rules (15A NCAC 2H .0500) or any Buffer Rules? If no, please provide a short narrative description: We have reviewed the "DRAFT Internal Policy Cumulative impacts and the 401 Water Quality Certification and Isolated Wetland Programs" document prepared by the NC Division of Water Qualit oY n April 10, 2004, version 2.1. While it does suggest that commercial development can result in cumulative impacts, this proposed development is small in nature and is within a landscape that is already commercial in nature Also future growth would be limited by the proximity of Interstate 85 to the north of the subject property It is not expected that the proposed commercial development will induce any additional future gxowth that is not already occurring in this area. Additionally the stormwater treatment facilities are being desired to meet DWQ's design standards and therefore, it is not expected that there will be any resultant downstream water quality degradation We anticipate that you will advise us if a qualitative or quantitative impact analysis is required. XV. Other Circumstances (Optional): It is the applicant's responsibility to submit the application sufficiently in advance of desired construction dates to allow processing time for these permits. However, an applicant may choose to list constraints associated with construction or sequencing that may impose limits on work schedules (e.g., draw-down schedules for lakes, dates associated with Endangered and Threatened Species, accessibility problems, or other issues outside of the applicant's control). Durham has a requirement which states that all parcels must front on a pudic ROW. The ROW of way will have to cross over two streams to access the pare! in question. Due to the size ~ the parcel it is unusade for any development as a stand alone parcel and the ROW of wdl serve no benefit This parcel was seated during the acquisition of the land for the 1-85 corridor. It appears that the property owner was compensated for the land at the time twt the parcel remained under the ownership of the original owner. TN 37402 p 423.266.4990 / f 423.266.5700 GLENN VIEW STATION PRELIMINARY STORMWATER MANAGEMENT PLAN Genercl Descrinrtion Glenn View Station is a proposed shopping center to be located south of Interstate 85, north of Geer Street and west of Junction Road. The 55.51 acre property is currently zoned NC RD and the proposed zoning is SC (Dj. The project is to consist of the shopping center buildings, parking and utilities. The project is located in the F/J-B Watershed Protection District and the Neuse River Basin. The high-density option will be utilized, allowing the impervious percentage to exceed 24% and limiting the impervious percentage to 70~. All impervious surfaces associated with the project will be treated for 85% TSS removal. The owner of the property is currently in the process of applying for permits to impact stream buffers and wetlands. This narrative and accompanying calculations are to serve as the preliminary stormwater management plan for the project. Water Quality All impervious surfaces will be treated for 85~ TSS removal. This will be accomplished with a central extended detention wetland. Areas of the property that don't drain to the central extended detention wetland will be treated with other extended detention wetlands or by stormwater Best Management Practices (BMP's) as described by the latest approved version of the North Carolina Division of Water Quality Best Management Practices- Manual. The current site plan has the entire site draining to one central wetland. This is the most efficient manner to treat the entire project. The extended detention wetland has been preliminarily graded and .designed such that it will appropriately treat the impervious area that is an#icipated to drain into the wetland. Preliminary surface area calculations are included with this report that show the actual surface area provided is greater than the surface area required. The impervious area reported in the calculation is based upon measurement of the ac#ual footprint of the impervious area based upon the latest proposed site plan footprint. With City/County of Durham setback, buffer and landscaping requa~ements, it would be difficult to exceed the amount of impervious surfaces reported in the calculation. 1 2- and 10-Yecr Peck Flow Detention Per Durham County Ordinance, the peak flow resulting from the 1-, 2-and 10-year storm events will be detained below that of the pre-development peak flow. The proposed stormwater Extended Detention Wetland will be utilized to provide this detention. Conclusion 85~ TSS removal and peak flow detention will be provided to treat all impervious surfaces associated with the site using an Extended Detention Wetland.
