This office has reviewed the submitted reclamation plan and is approving this plan with the following exceptions: • If the site is expanded by more than 1 Acre, or is significantly changed as determined by the Engineer, you will be required to submit a revised or additional reclamation plan. • A one year post -final compliance will be held and the property owner shall allow access to the Contractor's and North Carolina Department of Transportation's personnel to review and /or perform maintenance. • The GPS coordinates for the boundaries of the pit shall be provided to this office. • Before excavation in the borrow pit the pit shall be clearly marked to indicate the boundary of the pit. If excavations extend below that represented by the samples taken, additional samples need to be taken prior to excavating. • The existing haul road may need erosion control measures depending on the condition and future condition of the roadway. • Stabilization requirements in the Borrow and Waste Pit shall comply with NCGO1 as stated in the contract on page 53 entitled Stabilization Requirements. • The only waste allowed in the waste pit is stone and uncontaminated soil as listed on the Reclamation Plan for Contracted Projects Waste Pit form. Anything else to be wasted shall be requested and approved by this office prior to wasting the material. I understand that this plan, when approved, will serve as a guide in controlling erosion and sediment in accordance with the Mining Act and the Sediment and Pollution Control Act and as enforced by the North Carolina Department of Environment and Natural Resources (DENR). I understand that any work exceeding the minimum necessary for compliance with DENR requirements, should be negotiated between the Contractor and the Property Owner. My signature below authorizes The Department of Transportation (DOT), the Department of Environment and Natural Resources (DENR) or its agents, to enter upon my property for a period of one year from the date of final acceptance of the project for which this site plan is executed. This report summarizes our findings for the site. Background ECS was contracted to determine if waters of the U.S. (including wetiands) or endangered species are present on the site located west of U.S. Highway 15/501 in Moore County, North Carolina (Figure 1). The site contains wooded land that consists of a mot pine/hardwood forest that appears to be approximately five to ten years old. The proposed borrow pit is approximately 13 acres in area based on GPS measurements. ECS was contracted to determine if wetlands or endangered species are located on the site. Wetlands are defined by the U.S. Army Corps of Engineers and the United States Environmental Protection Agency as `those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and under normal circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil conditions" In order for an area to be classified as wetland, hydrophytic vegetation, hydric soils, and wetland hydrology indicators must be present. Literature Review We reviewed the USGS Topographic Map and the Soil Survey of Moore County for the site. The USGS Topographic Map (Figure 1) does not identify surface waters or wetlands on the site. The map shows an unnamed tributary to Aberdeen Creek located approximately 200 feet northeast of the site. Other surface waters or wetlands are not depicted within 500 feet of the site. Drainage swales that could contain surface waters are located on the adjacent property east. Elevations on the site range from approximately 430 feet above mean sea level near the southern boundary to approximately 390 feet above mean sea level near the northern boundary. The Soil Survey of Moore County (Figure 2) shows soils on the site have been mapped as Candor sand (CaB and CaC) and Vaucluse loamy sand (Val)). ECS Florida, LLC • ECS Mid- Atlantic, LLC • ECS Southeast, LLC ECS Texas, LLP Proposed Borrow Site — U.S. Highway 151501 Moore County, North Carolina ECS Project 09-21857 October 8, 2011 consists of somewhat excessively drained, moderately high saturated hydraulic conductivity soils that occur on uplands in the sandhills and upper coastal plain. The Vaucluse soil series consist of well drained, moderately slow to slow permeable soils that occur on marine terraces and uplands in the middle and upper coastal plain. The Vaucluse soil series is identified on the Hydric Soils List of Moore County as having hydric inclusions of the Johnston (undrained) soil series. The Candor soil series is not identified on the Hydric Soils List for Moore County. Site Reconnaissance ECS personnel conducted the site visit on October 3, 2012. The site contains wooded land that consists of a mix pine /hardwood forest that appears to be approximately five to ten years old. The proposed borrow pit is approximately 13 acres in area based on GPS measurements. Figure 3 shows the borrow pit corners as located with a Trimble GPS unit. During our reconnaissance, we observed the site for evidence of stream channels, wetlands and ponds. There are no streams, ponds or wetlands located in the proposed pit. The soils are bright and well drained. There is no evidence of groundwater discharge in the proposed borrow site. A Routine Wetland Determination Data Form containing field observations at the lowest lying area of the proposed borrow pit that supports our opinion is included as an Attachment. We also observed adjoining properties during our reconnaissance. Adjoining properties contain a sewer line easement, wooded land and fields. Based on the USGS topographic map, there is a stream located approximately 200 feet northeast of the site. Based on conversations with Mr. Richard Oldham with Sanford Contractors, at least a 200 foot minimum undisturbed buffer will remain between the borrow pit and the stream associated wetlands. We did not'obserre other streams or wetlands within 200 feet of the borrow site. Catch basins and erosion control fencing will be used to prevent impacts to off -site streams, wetlands and ponds. A reclamation plan is currently being designed for the site. Based on our observations, the proposed project will not impact off -site streams, ponds or wetlands. Endangered Species Survey We reviewed the North Carolina Natural Heritage Program list for federally listed threatened and endangered species that have been identified on the Pine Bluff, North Carolina Quadrangle (the quadrangle that contains the site). No federally listed threatened or endangered species are identified on the site quadrangle. Based on our observations and to the best of our knowledge, the proposed project will not impact federally protected species or areas that may be considered potential habitat for federally protected species. Proposed Borrow Site — U.S. Highway 151501 Moore County, North Carolina ECS Project 09-21857 October 8, • 2011 State Historic Preservation Office (SHPO) ECS submitted a request to SHPO on October 5, 2011 to determine if they are aware of historic resources that could be affected by the project. (The SHPO response will be mailed to Mr. Richard Oldham of Sanford Contractors.) Watershed Classification/Buffer Requirements An unnamed tributary to Aberdeen Creek is located northeast of the proposed borrow area. According to the North Carolina Division of Water Quality, the site is located in an area of the Lumber River watershed that has been designated as Class C waters. Based on conversations with Mr. Richard Oldham with Sanford Contractors, at least a 200 foot minimum undisturbed buffer will remain between the borrow pit and the stream associated wetlands. Water Table The project will consist of borrowing material from a ridge and leveling it consistent with existing topography of the undisturbed buffers that will be left around the perimeter of the borrow pit. There will be no dewatering, mining or excavating below the seasonal high water table or nearby streams or wetlands. Therefore, the existing water table will not be impacted by the proposed project. Recommendations The site is being evaluated for use as a borrow pit. Based on the findings of this study, it is our opinion that the project will not impact streams, wetlands or federally listed endangered or threatened species /associated habitat. Best management practices, including the construction of catch basins and the use of erosion control fencing, will be used to prevent sediment from running off the site and impacting off -site streams and wetlands.
