Division of Water Resources' Central and Regional staff has reviewed the application package
received November 3, 2020, the first response submittal received February 5, 2021, and the second response
submittal received April 19, 2021. However, additional information is required before the review may be
completed. Please address the item on the attached page no later than the close of business on July 6, 2021.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding item
listed in Section A, or failure to provide the additional information on or before the above requested date

A. Floodway Regulation Compliance
Per 15A NCAC 02T .0105(c)(8), documentation of compliance with Article 21 Part 6 (Floodway
Regulations) of Chapter 143 of the General Statues is required for new and expanding facilities.
The proposed modification is located within the 100-year floodplain and requires this
documentation for permit issuance. Within Chapter 143 Article 21 Part 6 of the General Statutes,
it is stated that a local government may adopt ordinances to regulate uses in flood hazard areas and
grant permits for the use of flood hazard areas that are consistent with the requirements of this Part.
Please provide documentation that local ordinances have been met. Please note that this
documentation is to be provided by a local government entity (i.e. Chatham County) and is separate
from the 401/404 permitting process that has been discussed in previous response submittals.
Please review the attached 02T rule excerpt and Chapter 143 Article 21 Part 6 of the General
Statutes and provide the written documentation of compliance, as required.
