Good Afternoon April, I apologize for the time that has elapsed since we last spoke without an update. I am hoping that this application hasn't been closed out in the meantime. The proposed work of this project has been slow to review by the Chapel Hill stormwater staff. We have made their requested changes, as well as the ones that we discussed back in April, including: 1. Change from NWP13 to NWP27. The proposed stream alignment has been changed to remove channelization of the stream since NWP27 does not allow for any channelization. 2. Removal of the proposed pedestrian footbridge. This was ultimately not approved by Chapel Hill. 3. Buffer Revegetation included in the Planting Plan. The planting plan now includes container tree plantings to revegetate the buffer to a density exceeding the requirement given by Chapel Hill. If I am remembering correctly, you asked for us to provide the stream determination form with the updated plans. You mentioned that you would handle the upland form and updating the impacts total from our PCN application. Please let us know if this is no longer the case. I have some follow up questions/discussion regarding this project: 1. We believe that we actually need to receive verified use of NWP27- Restoration. This more accurately encompasses the proposed work. 2. In the previous impacts inventory sheet, we mistakenly listed the buffer impacts and stream impacts as permanent rather than temporary. No Buffer Area nor stream length is being permanently altered as a result of the proposed work. The exception is the proposed pedestrian bridge, whose permanent buffer impacts have been retained on the impacts inventory sheet. 3. Given 1 and 2, does this remove the need for compensatory mitigation? The stream impacts are not permanent, and has been updated to show this in the impacts inventory sheet. 4. Given 1 and 2, do we still need to submit an upland data form? There are no impacts to wetlands by the proposed project. I have not needed to submit this for past NWP27 projects, so I'm not clear on whether this request was a result of having the wrong NWP number and incorrect impacts. If we do still need it, could you direct me to the upland data form, I had trouble locating it. 5. You mentioned informal consultation with USFWS concerning endangered mussel species. Do we need to do/provide anything on our end to facilitate this? I have attached the updated plan set, which shows the changes to the impacts inventory sheet I mentioned above. Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1) Your PCN included proposed impacts to streams; however, a delineation was not included with the application. Please submit a wetland delineation for the proposed impacts, with the applicable wetland datasheets. If wetlands are not impacted by the proposed project, please submit an upland data form. Typically, compensatory mitigation is required at a 2:1 credit to impact ratio unless otherwise justified based on evaluation of aquatic function. 3) Please include any proposed temporary impacts on the Impacts Inventory sheet, such as any dewatering activities. 4) Given the proximity of this project to known populations of several threatened/endangered mussel species, as well as potentially suitable habitat for these species occurring the project action area, we will initiate informal consultation with the US Fish and Wildlife Service (USFWS).
