If I do not hear back from you I will assume this is settled. I will try to be as brief as possible. In 2019 I made a deal with PAUL BELANGIA to lease "BRIDGETON SOIL" mine from him. Location is 440 n phillips avenue bridgeton. BELANGIA had secured a stormwater permit before I leased said mine. BELANGIA has some health problems and will probably not be able to operate the mine again but he still owns the land and he secured the original permit independently of me around 2014. He intends to develop the mine site after reclamation. When I leased the mine, I filed paperwork with DEMLR to change the official name from "bridgeton soil' to "BRIDGETON SANDMINE" this is where it gets very complicated. Approximately 1 year ago, PAUL BELANGIA (who still owns the land) attempted to pay his yearly bill for his stormwater permit. The charge was, I believe, $100. BELANGIA sent in $200, attempting to pre -pay this permit by 1 year so that it would not lapse if he somehow forgot in the future. The staff returned the check, and BELANGIA mailed it to me. I called the staff (this was in 2020) and they basically said "he is current and we cant accept prepays" so I destroyed the check. This week BELANGIA contacted me again and said that your department has sent him a notice of violation, with the threat of a very large fine attached if he does not pay, saying he is not current. Given that he attempted to prepay for 2021 and was rejected, he was understandably very unhappy at this notice. I called your department and they said that he WAS current and that the notice was somehow in error. The NOVs make the landowner believe that I am not following my lease terms with the state by keeping current permits. I am having a hard time explaining to him that we are not in violation. If I do in fact owe you permit fees please call me immediately at 252 6713172 and I will pay you by credit card immediately over the phone OR I will mail you a check within 1 business day. I am not sure what the truth is so I am writing you this letter. My response to the NOV is this: 1. I have leased BRIDGETON SOIL from Paul Belangia and changed its name. 2. We are being sent conflicting info from your department and we are not sure what the truth is or how to get to the bottom of it. 3. We will gladly pay the $100 yearly fee for the permit. We are willing to pay you one year in advance for the permit just to be safe. 4. I have used all methods available to me to settle this issue. If I get any more NOVs about nonpayment, I will be showing this email as proof. It is my suggestion that you complete the following form to change "Ownership" of the mine from Mr. Belangia to the Company name it is operated under and is registered with the NC Secretary of State. This will keep correspondence from being sent to him. . Facility name or ownership, complete the Name/Ownership Change Form. If you do not wish to change the "Ownership, please email your phone number and mailing address to be entered in as the Billing Contact. This will ensure all future invoices will be sent to your attention. Please note that the billing month for this certificate of coverage is March. There are no outstanding permit fees.
