DAVIS Director MEMORANDUM NORTH CAROLINA Environmental Quality TO: Curt Weychert Assistant Major Permits Coordinator, Wilmington FROM: Tara MacPherson District Manager, Wilmington DATE: February 24, 2021 SUBJECT: Minor modification request State Permit No. 44-07, Northern Riverfront Marina, Wilmington, New Hanover Mr. Steve Morrison with Land Management Group, Inc. and acting agent for Northern Riverfront Marina and Hotel, LLC (also known as Port City Marina) is requesting to modify State Pen -nit No. 44-07. State Permit No. 44-07 was originally issued to Riverfront Marina c/o City Mariana of Wilmington, LLC on March 30, 2007 for the redevelopment of the old Almont Shipping Terminal site along the Northeast Cape Fear River. State Permit No. 44-07 was modified on October 9, 2012 to allow revision of the authorized dredging depth within the marina basin and the on -site disposal handling plan, and reconfiguration of a section of bulkhead on the north end of the project. A Letter of Refinement to State Permit No. 44-07 was issued on November 7, 2013, which authorized the reconfiguration of the authorized stormwater management of the site in the location of Harnett Street. The permit was modified on November 9, 2015 for upland development changes and an expansion of the authorized dredge footprint and was modified again on January 14, 2021 for a new spoil disposal site. Permit No. 44-07 was renewed on January 7, 2020 and is currently due to expire on December 31, 2021. Mr. Morrison states the applicant is requesting modification to the existing permit for the completion of Phase 2 of the marina project. According to the proposal, the modification would consist of rearranging the existing 114 slips completed during Phase 1 with the addition of 80 boat slips within the authorized marina basin footprint. The new configuration would retain 32 transient boatslips as required by State Permit No. 44-07 (see Conceptual Dock Layout Option IV A dated rec'd 1/22/21). The new configuration would result in the addition of 80 boatslips for a total of 194 slips plus two additional transient slips on the outer T-head of A -dock. The marina currently has authorization for up to 204 slips. The proposed reconfiguration is within the existing marina footprint (see Conceptual Dock Layout Option W B dated reed 1/30/21 and Conceptual Dock Layout Option IV C dated reed on 2/18/21). A -dock was never constructed. An approximately 486 ft. long by 9 ft. wide pier is proposed with 40 triangular shaped floating docks that are 53 sq. ft. each. A T-head measuring approximately 111 ft. long by 18 ft. wide is proposed at the terminal and of A -dock providing 2 transient slips for boaters. A -dock will provide 43 new permanent boatslips. B-dock was previously constructed with 27 boatslips and would be expanded to accommodate 25 additional slips for a total of 52 boatslips. According to the applicant, slips 11-19 on B-dock would be reserved for transient boaters. B-dock will be extended approximately 160 ft. towards the Cape Fear River (CFR) with 14 new fingers piers on the southern side measuring 30 ft. long by 3 ft. wide. The northern side of the pier would be expanded with 10 new finger piers measuring 50 ft_ long by 5 ft. wide. The new T-head would measure 90 ft. long by 10 ft. wide. C-dock is proposed to be expanded to accommodate an additional 6 slips for a total of 40 permanent boatslips. The existing 10 ft. wide pier would be extended approximately 100 ft. towards the CFR. Two additional finger piers would be installed on the southern side of the pier extension measuring 48 ft. long by 5 ft. wide. Three additional finger piers would be installed on the northern side of the extended pier measuring 60 ft. long by 6 ft. wide. D-dock would be reduced by 4 slips for a total of 22 permanent boatslips. According to the applicant, D-dock would shift 20 ft. landward towards the existing bulkhead. Four new forger piers are proposed on the northern side measuring 60 ft. long by 6 ft. wide. The new T-head would measure 115 ft. long by 10 ft. wide. E-dock runs along the eastern side of the most northern corner of the bulkhead and no structures are proposed in this area. E-dock would accommodate 5 side -to transient slips along the bulkhead. F-dock is proposed to begin on the northern side of the bulkhead adjacent to E-dock. F-dock would be constructed with a new seating area measuring 60 ft. in length by 24 ft, in width. A 60 ft. long by 6 ft. wide floating dock would extend to the south from the seating area and an additional 60 ft. long by 6 ft. wide floating dock would be installed at the terminal end running parallel with the shoreline. F- dock previously accommodated 4 boatslips. As proposed, 12 additional slips are proposal for a total of 16 transient boatslips. G-dock would still extend along the eastern side of the existing concrete pier and would accommodate 6 side to boatslips. H-dock and I —dock extend along the remainder of the existing concrete pier with 2 slips on H-dock and 10 slips on I -dock. There are no additional structures proposed in this area. Four slips on I -dock are designated exclusively as transient. It is the staffs recommendation that the proposed reconfiguration appears to be consistent with 15 NCAC 071T_0208 (b)(5) and existing permit conditions that require 32 slips be designated as transient slips. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. The agent has submitted a check (414477) in the amount of $100 for the modification request. By copy of this memo, DCM is requesting that the USACE, DWR, DEMLR, City of Wilmington and NH Co., provide any comment that your agency may have on the proposed project to Curt Weychert of DCM's Morehead City office within 14 days of receipt of this memo. Tara, The triangular pieces are part of the floating dock and would be considered as platforms. The dimensions of those are 20'-8"x20'x5'-4" or 53.6 square feet each. The one oddly shaped piece about halfway out on the southern side of A Dock is a transformer platform and measures 20'x10'-4"x20'-8"x 5' or 150 square feet. I hope this helps. Thanks. The modification consists of the rearrangement of boat slips within their man-made marina basin within the limits of their authorized original 204 slip project. Phase 1 of the marina as completed features 114 slips. Following the completion of this Phase 2, the marina will feature 194 slips. The attached materials provide details regarding the proposed revision. They include spreadsheets showing the existing and future linear footage of dockage, the existing and future slip count per dock with totals, the proposed dock layout drawing, the numbered slip count layout and a copy of the latest renewal of CAMA permit number 44-07.
