PROJECT SUMMARY: The project proposed is located along the Urban Waterfront area of Morehead City. Although the project area is along one parcel of land with two restaurants and five commercial fishing slips, each site has a historical use as an individual entity. The project involves the relocation of the existing floating pier and platform, the addition of three fixed platforms and the loss of one slip area (going from 4 to 3). There is no high ground work proposed. Field Investigation Report: Ruddy Duck Tavern Page 02 9. Narrative Description The Ruddy Duck Tavern project is located along the Morehead City waterfront (designated as urban waterfront area) within the Morehead City Harbor area of Bogue Sound at 509 Evans Street. The tract is bordered by DMA Charter LLC to the east and 513 LLC (Jacks Waterfront Bar) to the west. The Ruddy Duck Tavern property is 34,703.09 square feet (.80 acres) in its entirety, has a shoreline length of 335' and is an average of 4' above NHW. Presently there is an existing bulkhead, two restaurants with docking facilities', one private slip with boatlift for the adjacent neighbor and five commercial fishing boat slips. Each site along the tract has a historical use as a separate entity. There are no coastal wetlands or high ground vegetation on this tract. The Morehead City Land Use Plan classifies this property as Downtown Mixed Use, with all AEC's classified Conservation. This section of the Bogue Sound (Morehead City Harbor) is not designated as Primary Nursery Area, is closed to the taking of shellfish and carries a water classification of SC. There are historic riparian corridors within this area and shall pertain to the newest proposal and meet all required setbacks. Substrate in the Morehead City Harbor is mostly sand and silt. No SAV's or shellfish beds were observed within the proposal project area. There is a USACOE federal channel setback within the project vicinity (approximately 99' from nhw /mhw). 10. Project Description: The applicant's current proposal is to construct three fixed platforms, remove one of the four existing slips for a total of 3 and relocate the existing floating pier and platform to the edge of the USACOE channel setback. The applicants are proposing to shift the existing floating pier and platform 1' -2' south so it is located along the USACOE channel setback. The shift of the floating pier and platform would not encroach over the setback. The applicants have stated there would not be any pilings located within this area. They are also proposing the construction of three fixed platforms along the existing docking facility. There would be a 6' x 30' fixed platform starting along the southeast portion of the existing restaurant. It would run parallel with the existing restaurant and extend west for 30'. It would attach to an 8' x 8' fixed landing that would be used for the existing pier and platform gangway. A 23' x 23' fixed platform would extend from the west side of the proposed 8' x 8' fixed landing. The water depths within the slip areas are approximately 10' to 14' nlw /mlw depending on location. The development encroaches within the 15' riparian setback on the west side; however 513 LLC has signed the 15' waiver. The tidal amplitude within this area is approximately 3.08'. The total length of the shoreline is 335'. The waterward edge of the proposed platform would be located a distance of 99 feet from nhw /mhw and along the USACOE channel setback. The width of the Morehead City Harbor is approximately 397' in this area. The proposed pier and platform shift would extend a maximum of 99' waterward of nhw /mhw within a 397' wide waterbody. According to the applicant, the typical boat would be 12'- 25'with a mixed use open runabout design. The slips would be of a transient nature, would prohibit overboard discharge, as well as prohibit fueling and Field Investigation Report: Ruddy Duck Tavern Page 03 overnight or live aboard dockage. There are no impervious surface impacts due to the project is entirely over estuarine waters. 11. Anticipated Impacts: The proposed pier and platform would shade 773 ft2 and incorporate 1,920ft2 of open waters. The setting of pilings would cause temporary turbidity. There would be no hindrance to navigation due to the fact that the docking facility would be located a maximum distance of 99' waterward of nhw /mhw and along the channel setback but not encroach within it. No pilings would be within that area either. The width of two portions of the new access areas would be greater than six feet however, the two 8' wide accesses would provide for greater safety and improve public use access. The additions would meet 15A NCAC 0711.0208 (b) (6) (b). All portions of the development would not extend farther than 99' waterward of nhw /mhw within the 397'wide waterbody. This project has the potential to improve public benefit by adding additional public access. The property currently has two restaurants located on it, the Ruddy Duck Tavern and the Sanitary Fish Market and is owned by the Vernon Jackson Garner, Jr. Trust. There are five, approximately 55' boat slips between the two restaurants for use by charter fishing boats. The Ruddy Duck Tavern facility currently has a "T" shaped floating dock landward of the U.S. Army Corps of Engineers Setback Line. The Ruddy Duck Tavern Dock Relocation and Fixed Timber Platform project includes moving the channelward edge of the current floating dock system to the Channel Setback Line and the construction of two fixed timber platforms. No additional boat slips are being proposed as part of this project. EXISTING CONDITIONS The Ruddy Duck Tavern currently has a fixed timber platform on the southern side of-the structure. A gangway connects this platform to a "T' shaped floating dock that is landward of the Channel Setback Line. The portion of the floating dock that is parallel to the Morehead Harbor Channel is 52'x 8' and the perpendicular portion is 20'x 8'. The floating dock currently has four (4) boat slips associated with it. There is a 10' x 26' private boat lift owned by the adjacent property owner on the western portion of the project between the platform and the adjacent property. PROJECT DESCRIPTION RECEWED APR 0 9 2013 Demolition and Removal — The only demolition and removal proposed in this project is MHDCITy removal of the existing handrail once construction of the entire platform is constructed. Upland Development —There is no Upland Development planned as part of this project. Stormwater Management — No upland improvements, pavements, walkways or other impervious surfaces will be constructed as part of the project. No stormwater management or additional stormwater measures are required for this project. NAVIGATION CONDITIONS The federal channel boundary and channel setback run along the entire southern margin of the project site. The federal channel is 100 feet wide. The channel and setback lines shown on the drawings were obtained from the Navigation Section, U.S. Army Corps of Engineers, Wilmington District. METHODS OF CONSTRUCTION Construction of the timber platform will be by conventional marine construction equipment including barges and cranes. The equipment will be onsite only a sufficient time to complete the pile driving and pier installation work. PROJECT SCHEDULE After the required CAMA Major permit is obtained, construction of the dock relocation and fixed timber platforms will begin immediately. COMPLIANCE WITH THE N. C. ENVIRONMENTAL POLICY ACT The work proposed as part of this application is private development and does not involve expenditure of public funds. Since the project involves construction of no additional boat slips, review under N.C. Environmental Policy Act is not required. Give complete description: The Ruddy Duck Tavern Dock Relocation and Fixed Timber Platform project includes moving the channelward edge of the existing floating dock approximately 1 foot so that it is flush with the federal channel setback line. A new 23'x 23' fixed timber platform will be constructed off of the existing timber platform with an 8'x 8' landing where the gangway will be installed to reach the existing floating dock. A railing will be installed along the entire perimeter of the fixed deck. A 30'x 6' fixed timber platform will constructed on the eastern half of the south facing portion of the structure.
