On August 3, 2011, the Division of Water Quality (DWQ) received your application dated July 28, 2011, to fill or
otherwise impact 2,500 square feet of open water below the normal pool lake level and 7,072 sqaure feet above the
normal pool lake level for the purpose of constructing a free public boating access area with a concrete launch ramp,
floating courtesy dock, and parking area. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five
copies of the additional information requested below, we will place this project on hold as incomplete until we
receive this additional information. If we do not receive the requested information, your project will be formally
returned as incomplete. Please provide the following information so that we may continue to review your project.
Additional Information Requested:
L Per the GC 3693, "if concrete is used during construction, then a dry work area should be maintained to prevent
direct contact between curig concrete and stream water. Water that inadvertently contact uncured concrete
should not be dishcarged to surface waters due to potential for elevated pH and possible aquatic life /fish
kills ". Please explain how you will accomplish this during construction especially given the time of year
(October) you propose to start and potential for large rain events.
2. Once obtained, please provide DWQ with the lease agreement from Progress Energy. This project will be put
on hold (at your request) until the agreement is obtained.
Please submit this information within 30 calendar days of the date of this letter. Please send requested

This letter only addresses the application review and does not authorize any impacts to wetlands, waters or

Agent Authorization and Approval for the Hyco Afterbay Public Boating Access
Area in Person County, North Carolina
Dear Mr. Christofferson:
Pursuant to Section 3 of the October 1, 1996, Gamelands Agreement between Carolina
Power & Light Company d/b /a Progress Energy Carolinas, Inc. (an indirect subsidiary of
Duke Energy Corporation) and the North Carolina Wildlife Resources Commission
( "Commission "), PEC hereby grants permission to the Commission to install a new
public boating access area at the Hyco Afterbay Gamelands Area. The installed
facilities will consist of a concrete boat ramp, courtesy dock, parking area, shoreline re-
vegetation, storm water runoff basin, and handicapped - accessible parking area for
access to the new boat ramp. This access area will provide boat launching capabilities
for the general public to use the Hyco Afterbay Gamelands. The Commission will be
responsible for the maintenance and upkeep of the facility.
This letter shall also serve as authorization for the Commission to act as an agent for
PEC including where necessary, authority to sign on its behalf, for the purpose of
obtaining the permits necessary for construction of the boating access area. This
authority is granted to assist the Commission in the acquisition of permits to satisfy
Section 404 and/or Section 10 Nationwide, Regional and General Permits, Section 401
general Water Quality Certifications, Riparian Buffer and Watershed Buffer Rules and
any other permits required for the proposed construction. No work shall take place until
all necessary permits are acquired.
Prior to opening the ramp, Duke Energy will work with the Commission to evaluate and
install necessary warning buoys and other navigational signage to ensure public safety
on the reservoir.
