On April 21, 2021, staff of the NC Division of Water Resources (DWR), Water Quality Regional
Operations Section (WQROS) noted during a compliance inspection a failure to have an analysis
of the representative sample of the animal waste to be applied as well as a failure to submit a
sludge removal or management plan to the regional office within ninety (90) days.
As a result of this incident, you are hereby notified that, having been permitted to have a non -
discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T
Section .1300, a violation has been noted for failing to provide a waste analysis for the waste to
be applied and for failing to submit a sludge management plan within ninety (90) days of
determination with your Certified Animal Waste Management Plan and the Swine Waste System
General Permit No. AWG100000 that you are covered to operate under.
Violation 1:
Failure to provide an analysis of a representative sample of the animal waste to be applied,
conducted in accordance with recommended laboratory sampling procedures as close to the time
of application as practical and at least within sixty (60) days (before or after) of the date of
application. Every reasonable effort shall be made to have the waste analyzed prior to the date of
application and as close to the time of waste application as possible, per Condition II1.5. of
Swine Waste System General Permit No. AWG100000.
The facility last had a waste analysis completed by a laboratory on September 18, 2019. Taking
into account the waste sample collection and analysis requirement waiver due to COVID, from
March 20, 2020 to June 1 St, 2020, there was no valid waste analysis for spraying events from
June of 2020 to the present.

The facility should plan to obtain an analysis of a representative sample of the animal waste to be
applied, conducted in accordance with recommended laboratory sampling procedures, as close to
the time of application as practical and at least within sixty (60) days (before or after) of the date
of application. A written response to this NOV is required.
Violation 2:
Failure to submit a sludge removal or management plan to the appropriate Division Regional
Office within ninety (90) days of determination, describing removal and waste utilization
procedures to be used, per Condition III.22.
In both lagoons, sludge levels were not compliant as of a sludge survey performed in 2020. No
sludge management plan was submitted to the Wilmington Regional Office.
Required Corrective Action for Violation 2:
The facility should submit to the appropriate Division Regional Office a sludge removal or
management plan as soon as possible for the lagoons in which the sludge is out of compliance.
You are required to take any necessary action to address the above violation. Please include
in your response all corrective actions already taken and a schedule for completion of any
corrective actions not addressed.
Failure to comply with conditions in a permit may result in a recommendation of enforcement
action, to the Director of the Division of Water Quality who may issue a civil penalty assessment
of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or
fails to act in accordance with terms, conditions, or requirements of a permit under authority of
G.S. 143-215.6A
