Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Site assessments were conducted in order to determine the best approach to stabilization the stream bank with minimal impact to the stream itself and the surrounding areas. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: As indicated on page 7 in Exhibit A: Sediment and Erosion Control Notes, proposed impacts through construction will be minimized by use of silt fence, check dams, and inlet protection devices depicted in drawings. Areas that are not to be disturbed will be clearly marked by fencing, signs, and flags. All soil stockpiles will be stabilized appropriately. Regular checks will be conducted to ensure all of these minimization measures remains in place throughout the duration of construction. 2. The water quality of Hare Snipe Creek (the receiving body of water) is a class C and considered Nutrient Sensitive Waters (NSW). The repair area is located within a maintained sanitary sewer easement and the site will be accessed via the existing sanitary sewer easement. Approximately 120 linear feet (LF) of streambank will be stabilized along the stream. The repair area is located within a 30-foot wide sanitary sewer easement. The sewer maintenance staff can access the site area by two different areas: • The first would be to utilize the sanitary sewer easement between 4340 and 4336 Pickwick drive. • The second option would be to utilize the sanitary sewer easement between 6504 and 6508 Dew Drop Court. The following activities are proposed at this location: • Erosion control measures and a dry work area will be established prior to work beginning. • The eroded area along the stream bank will be filled with appropriate backfill material. • The streambank will be stabilized with rock/geotextiles. • All disturbed areas will be seeded and mulched upon completion of work. The total temporary stream disturbance associated with this work will be approximately 120 LF and will be due to bank stabilization on the west side of the stream (towards Pickwick Drive). The total temporary wetland impact associated with the work at Pickwick Drive will be approximately 0.08 acres (3,345 square feet [sqft.]). The total temporary buffer impacts associated with this work at Pickwick Drive will be approximately 3,045 sqft. in the Zone 1 Buffer and 300 sqft. in the Zone 2 Buffer. Below are photos of the existing conditions at Pickwick Drive. Exhibit A 4340 Pickwick Dr. (Lat. 35.87102, Long. -78.70494) 1. A projection that preserves area, such as the Albers equal-area conic projection, should be used if more accurate calculations of distance or area are required. Based on the project area mapped with your request, a query of the NCNHP database indicates that there are no records for rare species, important natural communities, natural areas, and/or conservation/managed areas within the proposed project boundary. Please note that although there may be no documentation of natural heritage elements within the project boundary, it does not imply or confirm their absence; the area may not have been surveyed. The results of this query should not be substituted for field surveys where suitable habitat exists. In the event that rare species are found within the project area, please contact the NCNHP so that we may update our records. The attached ‘Potential Occurrences’ table summarizes rare species and natural communities that have been documented within a one-mile radius of the property boundary. The proximity of these records suggests that these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one-mile radius of the project area, if any, are also included in this report. If a Federally-listed species is found within the project area or is indicated within a one-mile radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here: https://www.fws.gov/offices/Directory/ListOffices.cfm?statecode=37. Please note that natural heritage element data are maintained for the purposes of conservation planning, project review, and scientific research, and are not intended for use as the primary criteria for regulatory decisions. Information provided by the NCNHP database may not be published without prior written notification to the NCNHP, and the NCNHP must be credited as an information source in these publications. Maps of NCNHP data may not be redistributed without permission. The NC Natural Heritage Program may follow this letter with additional correspondence if a Dedicated Nature Preserve, Registered Heritage Area, Land and Water Fund easement, or Federally- listed species are documented near the project area. If you have questions regarding the information provided in this letter or need additional assistance, please contact Rodney A. Butler at rodney.butler@ncdcr.gov or 919-707-8603.
