Good morning Lyle.
Below and attached are explanations and attachments that will help clarify proposed activities, impacts, avoidance, and
minimization of impacts for The Park at Wimberly in Apex.
Impact Sketch:
The attached impacts exhibit illustrates all proposed impacts to wetlands on the property. Channels connecting
wetlands in the western half of the property were ruled ephemeral by both the Corps and by Town of Apex staff. This
delineation was approved by the Corps during a field meeting June 2, 2020 (See attached sketch approved by James
Lastinger & April Norton). One wetland in the extreme western finger of the property was added to the delineation
after it was discovered during additional site work. Proposed impacts to this wetland feature are labeled as "W5" in the
previously submitted ePCN application.
Avoidance & Minimization:
Of the 43.52 acre property, 13.74 acres will be preserved through Resource Conservation / Buffer Areas. No wetlands,
streams, or other surface waters in the eastern portion of the property will be impacted by the proposed development,
and all features in this portion of the property will be protected by large Resource Conservation / Buffer Areas. All
proposed impacts are located in the western portion of the property. Avoidance of impacts to wetlands in the
southwestern portion of the property is impractical due to topography surrounding these wetland features. Where
possible, impacts are proposed as perpendicular crossings (Impact W1). Additionally, retaining walls have been utilized
extensively to avoid wetland and buffer impacts for SCMs throughout the property. Temporary impacts will be avoided
through the extensive use of silt fence and tree protection fencing to keep construction traffic out of wetlands, streams,
and buffers that are not intended to be impacted.

Mr. Mitchell,
I have reviewed the above referenced project and need the following comments/questions addressed prior to moving
forward with the evaluation of the project.
1) Per regional condition 32, sketches should be provided when necessary to show that the activity complies with the
terms of the NWP. (Sketches usually clarify the activity and when provided results in a quicker decision. Sketches
should contain sufficient detail to provide an illustrative description of the proposed activity (e.g., a conceptual
plan), but do not need to be detailed engineering plans).
a. Please provide sketches of the proposed activities that depict the proposed impacts. On the impact
sketches please depict the stream and wetland delineation approved by the Corps. These sketches are
necessary to verify that the proposed activities comply with the terms of the Nationwide Permit (NWP).
Sketches should contain sufficient detail to provide an illustrative description of the proposed activity (e.g.,
a conceptual plan), but do not need to be detailed engineering plans.
2) Provide a brief description of how the activity has been designed on -site to avoid and minimize adverse effect, both
temporary and permanent, to waters of the US to the maximum extent practical at the project site.
3) An additional request for information may be required after reviewing additional information provided.

9.CONTRACTOR IS RESPONSIBLE FOR DAMAGE TO ANY EXISTING ITEM AND/OR MATERIAL DUE TO
CONSTRUCTION OPERATIONS. ALL STREET SURFACES, UTILITY POLES, CULVERTS, DITCHES, CURB AND
GUTTER OR OTHER STRUCTURES THAT ARE DISTURBED OR DAMAGED IN ANY MANNER AS A RESULT OF

15.ANY SPECIALITY STREET SIGNS INCLUDING POSTS SHALL BE SUBMITTED TO THE TOWN OF APEX FOR
REVIEW AND APPROVAL PRIOR TO INSTALLATION.
16.DURING CONSTRUCTION, SIGNS READING "NO CONSTRUCTION VEHICLES THIS SIDE OF STREET" (IN
ENGLISH AND SPANISH) MUST BE POSITIONED SO AS TO DIRECT CONSTRUCTION VEHICLE PARKING TO
ONE SIDE OF THE STREET (OPPOSITE FIRE HYDRANTS).
17.TEMPORARY STREET SIGNS ARE REQUIRED ONCE THE FIRST LIFT OF ASPHALT IS PASSABLE.
18.MAINTAIN 3' CLEARANCE AROUND FIRE HYDRANTS, TO INCLUDE SILT FENCE.
19.PARKING SPACES INSIDE ROW SHALL BE PUBLIC PARKING, HOA MAINTAINED.
20.THERE SHALL BE A MINIMUM 4' WIDE CONCRETE ACCESS WAY AROUND ALL SIDES OF THE MAILBOX
KIOSK W/ MAX 2% SLOPE.
