Good afternoon Lyle,
We have provided responses to your concerns/questions below in bold and have provided referenced attachments for your review.
1. As stated in the PCN the road impact at Impact Area “C” is necessary to provide access to the future school site. As such, the present layout of roadway infrastructure at Impact Area
“C” for the proposed project does not depict logical termini leading to the potential for further/future jurisdictional impacts associated with additional impacts for construction of
the future school site, therefore the Corps is unable to determine whether the activity authorized under the nationwide permit will result in more than minimal individual or cumulative
adverse environmental effects. Please provide further information on the potential for adverse cumulative effects due to the stub road and the future school site. A retaining wall has
been added adjacent to the road access to the future school site and wetland impact C has been omitted from the site plan. Please see attached updated Overall Impact Area Map-Sheet
E1 and updated ePCN application.
2. As shown on the Overall Subdivision Layout C2.00 (attached) there is planned future development adjacent to South Salem Street. Can you provide information to support the independent
utility of the proposed development and the future development? According to the attached Preliminary Layout Plan C2.00 found on the Apex Development GIS map additional multifamily development
is proposed. Is the proposed future development to be completed by a different entity? Per the applicant Stephen Dorn of Lennar, “the planned future development adjacent to South Salem
Street will be a separate applicant. Furthermore, the future development will have separate access points off Salem Street per the PUD referenced. Lastly, these future developments
will not share any amenities with the Lennar development.” We’d also like to add that per the Spangler Delineation the areas adjacent to South Salem Street are uplands, see attached
“Poe Wetland Map 1.9.20”.

I have reviewed the above referenced project and need the following comments/questions addressed in order to proceed with the evaluation of the project.

Onsite (Residential Area):
Existing conditions onsite consists primarily of wooded and agricultural land with some rural residential structures located adjacent to South Salem St. There is one (1) perennial stream
feature (SA), three (3) intermittent stream features (SB-SD), six (6) wetland features (WA-WF), and four (4) ponds (P1-P4) located on the property. Pond 2 was determined to be in
upland and considered non-jurisdictional. Apex Barbecue Road bounds the property to the north while South Salem Street bounds the property to the east. General land use in the
vicinity of the project is primarily wooded/agricultural land as well as residential developments.
Offsite (Utility Area):
Existing conditions consists primarily of heavily forested land. There is two (2) perennial stream features (SA & Offsite SC), two (2) intermittent stream features (Offsite SB & Offsite SI),
three (3) wetland features (Offsite W1, Offsite W4 & Offsite W8), and one (1) pond feature (Offsite Pond 6) located on the property. Please see attached "Poe Property - Detailed
Sketch Offsite 2020" for exact locations of features.

The purpose of this project is to construct a multi-family residential development and its necessary infrastructure.
The overall project consists of the construction of a multi-family residential development to include but not limited to roadway infrastructure, onsite and offsite utilities, residential
structures, amenity center, greenway, and Stormwater Control Measures (SCM). Specifically, there are two (2) utility crossings that impact streams and wetlands, two (2) road crossings
that impact a stream and a wetland, and three (3) greenway crossings that impact streams and wetlands. Equipment typically used for construction and earthwork such as backhoes,
bulldozers, excavators, graders, pavers etc. will be utilized for this project.

E. Impact Justification and Mitigation
S&EC completed a wetland and stream delineation for the entire property in order to identify natural resources so that impacts could be avoided &
minimized to the maximum extent practicable. Proposed impacts include two (2) road crossings, two (2) utility crossings, and three (3) greenway
crossings. Impact Area B is proposed road crossing. Proposed impacts include permanent (i.e. culvert & headwalls), permanent-no permanent loss
(i.e. dissipator pad) and temporary (i.e. construction access) stream impacts. This road crossing is necessary to provide access to the property from
the existing stub road to the north and it will also provide an additional point of ingress/egress required by the Town of Apex for the proposed
development. Stream impacts have been minimized by utilizing cast-in-place head walls and cast-in-place retaining walls at the crossing, and by
utilizing a riprap dissipator that will reduce flow velocities and minimize stream degradation. Additionally, two (2) 42” RCP pipes are proposed to be
buried by 1’ to allow for aquatic life passage. And finally, a temporary diversion ditch, coffer dams, and check dam will be utilized during construction to
divert stream flows and minimize the release of sediments during construction activities. Impact Area C is proposed road fill. Proposed impacts include
permanent wetland impacts. This road impact is necessary to provide access to the future school site. Impacts have been minimized by utilizing 2:1
slopes. Compensatory mitigation at a 2:1 ratio is proposed to offset wetland losses. Impact Area E is a proposed offsite sanitary sewer crossing.
Proposed impacts include temporary stream impacts. This impact is necessary to connect to the existing “utility sleeve” under Highway 540 and
existing sanitary sewer to the west of Highway 540. Impacts have been minimized by crossing the stream at a near perpendicular angle. Impact Area F
is a proposed offsite sanitary sewer crossing. Proposed impacts include temporary stream and permanent-no permanent loss wetland impacts. This
impact is necessary to connect to the existing utility stub and manhole to the east of Kelly Road, west of Highway 540. Stream impacts have been
minimized by crossing the stream at a near perpendicular angle. Wetland impacts could not be minimized, the property owner would not grant an
easement for the sewer outside of the Zone 3 Town of Apex buffers. The utility easement width was minimized where feasible to reduce wetland
impacts. This easement will be a permanently maintained easement and wetland mitigation is proposed at a 1:1 ratio to offsite the wetland “change of
function”. Impact Area G is a proposed greenway crossing. Proposed impact include temporary wetland impacts to construct a boardwalk. This impact
is necessary to provide safe pedestrian connectivity on the western side of the development. Impacts have been minimized by utilizing a boardwalk
over the wetlands, therefore avoiding permanent wetland loss. Impact Areas H & I are proposed greenway crossings. Proposed impacts include
temporary stream impacts to construct a boardwalk in the two different locations. These impacts are necessary to provide safe pedestrian connectivity
from the residential lots in the northeast to the Amenity Center. Impacts have been minimized by utilizing a boardwalk over the streams, therefore
avoiding permanent stream loss. Previous Impact Area A was a sanitary sewer crossing. This impact was omitted and designed within the road
infrastructure. Previous Impact D was wetland fill. This impact was omitted. All temporary stream impacts will be brought back to pre-construction
stream bed elevations and the stream banks will be stabilized. All temporary wetland impacts will be brought back to pre-construction contours and the
existing adjacent wetland source will assist in the restoration of the wetland vegetation.

We have reviewed the “Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs” document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in-fill, most residential subdivisions and small commercial developments as well as agricultural
and silvicultural operations. The Depot 499 project is a residential development. Additionally, the project is located within the Town of Apex ETJ,
therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Water
Supply, Watershed Protection Program which limits development densities as well as requires protective riparian buffers; 2) the Jordan Watershed
Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to “diffuse flow”
requirements, which could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; and 3) the Phase II NPDES
Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post-

S&EC completed a Threatened & Endangered Species Report, to include a Self-Certification letter through the US Fish & Wildlife Service (USFWS), a
query through the NC Natural Heritage Program database, and an official Species List through the iPac. A formal request was sent to the USFWS on
January 21, 2021. S&EC received response from USFWS on February 4, 2021 that they concurred with the determinations made by S&EC that the
proposed actions is not likely to adversely affect a portion of the federally-listed endangered or threatened species, their formally designated critical
habitat, or species currently proposed for listing under the Endangered Species Act (ESA) with the exception of that surveys should be conducted for
