Authorizing development in New Hanover County at adj. to AIWW, Myrtle Grove Sound, Federal
Point Township , as requested in the permittee's letter dated 12/6/12., including the
attached_workplan drawings (1), "received in Wilmington" on 12/7/12
This permit, issued on March 12, 2013 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this modification authorizes the repair of the existing bulkhead by
removal and replacement of sections of bulkhead with associated whalers, piles, and gravel backfill as
indicated in the letter dazed 12/6/12 and the attached workplan drawing dated received in Wilmington on
12/7/12.
2) If deemed necessary by a Division representative during the course of the authorized activities, a
turbidity curtain shall be placed across the terminal end of the access channel at the point of entrance to
the boat basin to prevent unnecessary siltation into the adjacent water body. The turbidity curtain shall
remain in place until turbidity levels behind the curtain are equal to or lower than ambient levels.
3) If required, the turbidity curtain shall be constructed in a manner to allow for detachment for continued
vessel use of the basin.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
December 31, 2017
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

4) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
5) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Maintenance Clause
6) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation activities authorized by this permit and that notification include:
A. The number of the original permit;
B. A statement that no dimensional changes are proposed;
C. A copy of the original permit plan(s) with cross - hatching indicating the area to be maintained
and the area to be used for dredge spoil, and the estimated amount of material to be removed;
D. The date of plar, revision and the permittee's signature shown anew on the original plan.

7) No vegetated wetlands shall be excavated or filled, even temporarily.
8) This minor modification shall be attached to the original of Permit No. 160 -05, which was issued on
10/21/05 and the minor modifications issued on 6/28/06 and 1/23/12, and copies of all documents shall
be readily available on site when Division personnel inspect the project for compliance.
9) All conditions and stipulations of the active permit remain in force under this minor modification, unless
altered herein.
