Dear Mr. Dean:
The N.C. Division of Water Quality (the Division) received your application to permanently
impact 65 linear feet of stream on'IVlarch 11, 2013. The impacts are covered by General Water
Quality Certification Number 3890, which allows you to use Nationwide Permit NW39 when
issued by the US Army Corps of Engineers (USACE). In addition, you should obtain or otherwise
comply with any other required federal, state or local permits before you go ahead with your
project including (but not limited to) Erosion and Sediment Control, Non - discharge, and other
regulations. Even though the activity described within your application does not require
written concurrence from the Division, you are required to follow the conditions in the
attached certification.
If you change your project, you must notify us and you may be required to send us a new
application. If the property is sold, the new owner is responsible for complying with all
conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150
linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 02H
.0506 (h).
The following conditions are provided in order to further assist you with compliance with the
conditions of the General Certification:
1. Stormwater Management Plan (SMP) Approval Required
You are required to provide documentation of the Town of Holly Spring's approval of the
stormwater management plan for this project by providing EITHER:
Wetlands, Buffers, Stormwater — Compliance and Permitting (Webscape) Unit One

• A valid approval letter from the Town of Holly Springs indicating that the proposed
activity has an approved SMP and one copy of the approved SMP, including plan
details on full -sized plan sheets, calculations and other supporting information, OR
• A set of stormwater plan details on full -sized plan sheets, calculations and operation
and maintenance agreements stamped as "Approved" by the Town of Holly Springs.
The approved SMP must be submitted to the DWQ WEBSCAPE Unit before any impacts
occur. In addition, any approved future changes to the SMP should be sent to the DWQ
Webscape Unit (1650 MSC, Raleigh, NC 27699 - 1650).
2. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained jurisdictional
wetlands, waters and protective buffers in order to assure compliance for future wetland,
water and buffer impact. These mechanisms shall be put in place at the time of recording
of the property, or of individual lots, whichever is appropriate. A sample deed notification
can be downloaded from the Wetlands, Buffers, Stormwater, Compliance and Permitting
Unit web site at:

the sample deed notification may be modified as appropriate to suit to this project.
