Skvarla, III Governor Director Secretary April 9, 2013 Mr. Bobby Ham Greene Environmental Services, LLC 90 Ham Produce Road Snow Hill, NC 28580 DWQ Project # 2008- 0511v1 Greene County Re: Neuse River Riparian Buffer and Nutrient Offset Umbrella Mitigation Banking Instrument (UMBI) Approval of Year I Monitoring — Track L -8 Contentnea CreeklLittle Contentnea Creek Bank Dear Mr. Ham, On January 15, 2013, DWQ received a Year I Monitoring Report for Tract L -8 of the Contentnea Creek/Little Contentnea Creek Bank Parcel (CLCP) dated 2012 and submitted by Greene Environmental Services, LLC (GES). On January 28, 2013, Katie Merritt, with the DWQ, requested additional information regarding the subject Monitoring Report. Specifically, Ms. Merritt requested an explanation for data that included stem counts measured in 0.5 increments. On February 18, 2013, Ms. Merritt received a satisfactory response. On January 11, 2013, as part of the approval of the monitoring report, Ms. Merritt requested all credit ledgers along with corresponding sales' receipts and stormwater approval letters for sales' transactions between July 20, 2012 and December 1, 2012. On January 16, 2013, Ms. Merritt received the nutrient offset and riparian buffer credit ledgers for this bank. However, Ms. Merritt did not receive any stormwater approval letters verifying the amount of nutrient offset required by the local governments. In correspondence between Ms. Merritt and Jeff Becker with GES, it was discussed that GES must obtain verification of nutrient offset required from the designated local government prior to any sale of nutrient offset credits. Ms. Merritt concluded that all sales on the ledgers, dated January 5, 2013, were compliant. As mentioned in previous correspondence between Ms. Merritt and GES, DWQ will release the final 10% of nutrient offset and riparian buffer credits for the CLCP bank when five years of monitoring and maintenance have been completed for Tract L -8, the appropriate success criteria is achieved, and the conservation easement is assigned to a land trust approved by the DWQ.
