(SEGi) has been retained by THAI T LLC (herein referred to as the "Applicant') to request and secure USACE and DWQ approval to fill 0.087 acre of 404 jurisdictional wetlands on lots 3, 4 and 62, within the Covil Estates Subdivision. Two impacts are covered with this request. The first is an after -the -fact impact of 0.017 acre, which took place on lots 3 and 4, and the second is proposed fill on lot 62 and consists of 0.07 acre. The purpose for the impacts is to provide access and lot fill and is necessary to ensure that the project is economically feasible for the Applicant. The Applicant proposes to offset the impacts by making payment to the NCEEP at a 3.6:1 mitigation -to- impact ratio. Purpose and Need The purpose of this project is to construct three residential dwellings, with associated access drives, on lots owned by the Applicant, within Covil Crossings, a part of Covil Estates, off Covil Farms Road, in New Hanover County, North Carolina. II. Location and Existing Conditions The proposed project is located at 7006, 7007 and 7011 Locust Drive, within Covil Crossing, a section of Covil Estates subdivision, in New Hanover County, North Carolina (34. 26286 °N, - 77.8225 °W). From Market Street, take Gordon to Military Cutoff. At the intersection, take a right onto Military Cutoff and then a right onto Covil Farm Road. Take the second left, Sunset Harbor Dr., and then take the first left onto Locust Dr. (see Appendix A). All three lots are located on this cul-de -sac. An area of pine flat wetlands still remains between lots 4 and 5. Currently, most of the lots have been built out and infrastructure (roads, utilities, stormwater measures) have been installed throughout the subdivision (see Appendix B). III. Project History The Individual Permit (IP), as well as associated Division of Coastal Management CAMA Consistency Determination and Division of Water Quality Certification (WQC), was issued to Dallas Harris Construction. Immediately thereafter, the IP was transferred to Covil Crossing Group, LLC, who installed the roads, infrastructure and constructed most of the houses in the development. Unfortunately, like many subdivisions in New Hanover County, Covil Crossing fell prey to the collapse of the housing market and the remaining lots were turned over to the bank. Since that time, THAI T LLC, has purchased the lots, with the intention of building houses on them (see Apppendix C). Project numbers associated with the project ' A copy of the permit has been included (see Appendix D-F) Covil Estates - Lots 3, 4 & 62 Individual Permit Supplemental Documentation 5F_ G1 The previously issued EP and WQC authorized the permanent impact of 0.252 acres of 404 non - riparian wetlands and 0.48 acre of Waters of the US (see Appendix J). These impacts were to be offset by the Applicant's payment to the NCEEP for 0.504 acres of non -riparian wetland restoration credit and preservation of the remaining wetlands (1.1 acres) located within the project area. According to our records, payment to the NCEEP was fulfilled (See Appendix G), but the preservation was not recorded. IV. Project Description The Applicant anticipates impacting 0.087 -acre of jurisdictional wetlands with the development of lots 3, 4 and 62 (see Appendix H — Wetland Impact Map). Wetland Impact Summary . Heavy machinery, such as a bulldozer, grader, back hoe, and track hoe, will be utilized during the construction process. The machinery will be used to clear the land, stabilize the soil, establish grade and to transport and deposit the proposed fill material within the project boundaries. Sediment and erosion control measures will be installed prior to commencement of land disturbing activities. Coastal wetlands are not anticipated to be impacted by this project, and the project is located outside any Areas of Environmental Concern (AECs). A CAMA Consistency Determination is being prepared concurrently with this permit application and will be submitted to the USACE and DWQ upon receipt. Threatened and endangered species and archaeological concerns were addressed within the previously issued DoA and DWQ permits, as well as the DCM's CAMA Consistency Determination. No changes have occurred since the issuance of those authorizations. V. Avoidance and Minimization These impacts were accounted for with the original application submittal. During the permit process, the developer demonstrated avoidance and minimization by eliminating lots, specifically between lots 4 and 5 and lots 43 and 44, on the original site plan and even went a step further to eliminate another lot to further minimize the impacts (see Appendix I). Unfortunately, during the construction of the subdivision, the grading contactor did not have the revised plan and impacted the area of wetland located on lots 3 and 4. This impact was shown on plans previously submitted to the agencies. The wetland area between lots 43 and 44 has not been impacted and remains in its natural state. Alternatives The Applicant considered other potential means of developing the subject parcel, and has been unable to find a practicable alternative that would achieve his goal and meet his stated purpose. A. Alternative 1. — No Action The No Action Alternative (leaving the proposed impact areas undeveloped and restore unauthorized impact) would not be feasible, as not developing these lots would make the project economically impractical. B. Alternative 2. — Alternate Sites Using an alternate site is not feasible for several reasons: 1) all infrastructure and roadways are in place at the proposed site; all three lots are currently owned by the Applicant; and the Applicant builds homes equal in quality, design and size to the existing homes in the subdivision. C. Alternative 3 — Preferred Location The proposed impacts are the preferred alternative, as they provide the location specific impacts necessary to meet the purpose and need of the project. VII. Sequence of events Stormwater and S&EC permits were secured during the development of the subdivision and all of the infrastructure (roads and utilities) are in place. Thus, work is to commence as soon as DoA of the Individual Permit and Water Quality Certification have been issued. Work associated with the driveway access to lot 62 will consist of installing a 48" concrete manufactured pipe (see Attachment D for details). No work is required within lots 3 and 4, as this area has already been filled. VIII. Compensatory Mitigation Wetland Impact Area 2 was offset with payment to the NCEEP for 0.504 acre of non - riparian wetland restoration credit (see Attachment F). The Applicant proposes to compensate for the after -the -fact impact of 0.07 acre associated on lots 3 & 4, with payment to the NCEEP, at a 3:6 mitigation to impact ratio. A request for acceptance to make payment for 0.25 acre of non -riparian wetland credit has been submitted to the NCEEP. Once received, a copy will be forwarded to the agencies. IX.
