Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The project engineer made all attempts to avoid the impact. However, the power company who owns the powe line easement would not allow the off - site sewer to run parallel and within the maintained easement They would allow the crossing of the easement, which is proposed Unfortunately elevations at the crossing location are such that the sewer would be partially exposed, so the project engineer has proposed fill, rock protection and slight relocation of the existing non jurisdictional swales to protect the proposed sewer crossing (see attached impact exhibit). 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. All impacts have been minimized in size and configuration, such that the total wetland impact is only 0.09 acres (less than 1 /10th acres). The relocated swale would be constructed to allow the off -site linear wetland system to maintain hydrologic connection to the downstream wetlands. 2. The U.S. Army Corps of Engineers (Corps) identifies wetlands based the presence of three factors: a) hydrophytic vegetation indicators, b) hydric soil indicators, and c) wetland hydrology indicators. The purpose of my staffs inspection was to conduct a preliminary jurisdictional determination on the specific portion of the water conveyance (11- 0382C), starting at the storm water pond outlet pipe and ending approximately 563 feet downstream as shown on the attached Map- My staffs inspection revealed that the subject water conveyance does not exhibit the factors necessary to identify it as a wetland. Additionally, the conveyance does not exhibit an ordinary high water mark necessary to identify it as a regulated water of the United States. Based on these findings and the NCDWQ determination that the feature is not a stream pursuant to its rules, no authorization is needed from the Corps to undertake construction activities within the evaluated portion of the water conveyance (11- 0382C).
