Dear Mr. Jones and Mrs. Masta:
The Division of Water Quality (DWQ) has performed a preliminary review of a 401 Water Quality Certification
application submitted for the above referenced property. Additional information will be required in order to
complete the review process.
Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Application Item A. 3. Owner Information requests information related to the ownership of
the properties within the project area. A North Carolina Secretary of State website search reveals
that Michelle Masta is the president of both Black Bear Paving & Construction, Inc. and Skyros
Investments, Inc. Please provide explanation as to how these properties are utilized and
managed. (collective impacts)
2. Application Item B. 3c. requests the amount of all existing streams on the project properties.
The submitted plan appears only to depict the stream length between the terminal end of the
Skyros Investments, Inc. culvert, and the beginning of the Trinity Roofing Supply, LLC culvert.
Please provide the length of all streams within the Black Bear Paving & Construction, Inc. and
the Skyros Investments, Inc. property boundaries, including streams currently within culverts.

Additionally, please submit the approximate date of installation for the existing culvert on the
Skyros Investments, Inc. property.
3. Application Item D.1. Avoidance and Minimization requests that you describe what measures
you have taken to minimize or avoid impacts to surface waters with this project. Please provide
an alternatives analysis depicting the options considered in the planning of this project and your
rational for the option chosen. For example:
Using the Skyros Investments, Inc. property as access to the proposed gravel parking area
The use of significantly shorter culverts sufficient for vehicular access at either end of the
Black Bear Paving and Construction, Inc. property to create a "circular" point of access
The possibility of shifting the parking lot rearward on the property to minimize or avoid
impacts.
Please note that in Application Item D. 1. b. that a discussion of stormwater measures is not
considered a discussion of Avoidance and Minimization.
4. Application Item E. 2. Stormwater Management Plan requests the percentage of overall
imperviousness resultant from this project. Gravel roadways and parking surfaces are considered
impervious for these purposes. Please refer to the attached Pre - Construction (PCN) Form
Instructions for guidance on this section of the application. It does appear that a stormwater
management plan will need to be prepared and submitted to the Division of Water Quality for
approval should the impervious surfaces calculation provide results in excess of the stormwater
management threshold.
Please provide your response in writing to the addresses below prior to close of business on April 8, 2013. Four
copies of the required information should be provided to the Wetlands, Buffers, Stormwater Compliance and
Permitting Unit at:
