Sullins, Director Division of Water Quality The Division of Water Quality (DWQ) 401 Oversight and Express Review Permitting Unit has reviewed the revisions to the Restoration Plan for the above-referenced site. DWQ does not consider the proposed mitigation plan to provide satisfactory mitigation for the proposed impacts associated with the construction of the quarry. Based on the "piecemeal" nature of the proposed restoration enhancement activities, and the construction of ponds within the on-site streams, which will effectively isolate some of the proposed restoration reaches and prevent upstream/ downstream migration of aquatic life, DWQ feels that the water quality improvements and ecological uplift of the proposed mitigation activities will be minimal. In order to satisfy the mitigation requirements for the proposed project and satisfy the conditions of your 401 Water Quality Certification, you must submit an acceptable mitigation plan for the proposed impacts. Options to consider include the following: • Within the appropriate subbasin/USGS Hydrological Unit, identify a suitable reach of degraded stream for restoration. The selected restoration reach and or reaches (contiguous tributaries) must provide sufficient length to provide the required mitigation credits needed through restoration, enhancement or a combination of these; • Secure credits from an existing private mitigation bank with suitable available credits within the appropriate subbasin/USGS Hydrological Unit, if such a bank exists; or. • Apply to the N.C.
