Tom-
As discussed on Monday, please send me the following information, consistent with our MOA (IV.B.2):
• The Form 2F Application for Permit to Discharge Storm Water Discharges Associated with Industrial Activity
• The Fact Sheet's Reasonable Potential Analysis and "any calculations or other necessary explanation of the
derivation of specific effluent limitations" (40 CFR 124.56(a)) for pollutants detected on the 2D NPDES
application and the aquifer testing data referenced in the Fact Sheet
• The Water Quality Division's antidegradation review
It would also help us complete our review if you would provide me with a copy of the other water quality and habitat
studies that you referenced in your Fact Sheet:
• The October 10, 2012 Water Quality Analysis Technical Memorandum by Kimley -Horn and Associates that
modeled pH and salinity in Blount's Creek
It would help us make sure we make timely recommendations based on all the relevant facts about this proposed
project if you could also send to me:
• The Mining Permit Application
• The most recent Mine Plan
These documents include useful maps and drawings and other information that will help us confirm that the draft
NPDES permit addresses all potential pollutant sources associated with the proposed discharge.
I also wanted to let you know that we've obtained copies from the Pamlico -Tar River Foundation's website
(www.ptrf.org /proposedmine.php) of some of the water quality studies that you referenced in your Fact Sheet:
• The August 2011 Aquatic Habitat Assessment report prepared by CZR Incorporated
• The Sept. 6, 2012 Technical Memorandum from Kimley -Horn and Associations
• The Sept. 14, 2012 Engineering Alternatives Analysis
• The October 30, 2012 Technical Memorandum by CZR Incorporated
I'm not entirely confident that these documents are the same that you have in your files. For example, the EAA has
some hand - written notes on it and it's not clear to us whose notes they are. If you are satisfied that the PTRF web site
has the same documents that you have in your files then we can work with those. Please let me know.
We are coordinating with our colleagues in our Wetlands Regulatory Section on the 404 permit, potential water quality
impacts and the associated 401 certification. To that end we have also obtained copies from the PTRF's website of:
• The 404/401 application
• The North Carolina Department of Environment and Natural Resources Division of Land Resources Mining
Permit
Again, if you are confident that these are the complete and correct documents we can work with those. Please let me
know.
Sincerely,
Mark Nuhfer, Chief
