I also wanted to let you know that we've obtained copies from the Pamlico -Tar River Foundation's website (www.ptrf.org /proposedmine.php) of some of the water quality studies that you referenced in your Fact Sheet: • The August 2011 Aquatic Habitat Assessment report prepared by CZR Incorporated • The Sept. 6, 2012 Technical Memorandum from Kimley -Horn and Associations • The Sept. 14, 2012 Engineering Alternatives Analysis • The October 30, 2012 Technical Memorandum by CZR Incorporated I'm not entirely confident that these documents are the same that you have in your files. For example, the EAA has some hand - written notes on it and it's not clear to us whose notes they are. If you are satisfied that the PTRF web site has the same documents that you have in your files then we can work with those. Please let me know. We are coordinating with our colleagues in our Wetlands Regulatory Section on the 404 permit, potential water quality impacts and the associated 401 certification. To that end we have also obtained copies from the PTRF's website of: • The 404/401 application • The North Carolina Department of Environment and Natural Resources Division of Land Resources Mining Permit Again, if you are confident that these are the complete and correct documents we can work with those. Please let me know. Sincerely, Mark Nuhfer, Chief Municipal and Industrial NPDES Section EPA Region 4 61 Forsyth St, SW Atlanta, GA 30303 Nuhfer.mark @epa.gov 404 - 562 -9390
