Hey Tommy,
I have reviewed the Ivey Ferguson As-Built report and have the following comments. Thank you kindly for your patience.
Section 3.1
• There is no mention in the As-Built report that E8K installed fencing as proposed in the 8PDP. Please
add a statement that addresses this in Section 3.1.
• The BPDP says that EBX will choose atleast 3 shrub species, but the As-Built report suggests that no
shrubs were planted. As I have indicated in the past, DWQ used to require at least 1 shrub species for
nutrient offset mitigation in the form of riparian restoration. However, it has been since determined,
that shrubs are not required unless the bank chooses todoso. |f the bank chooses to plant shrubs, they
will have to meet the success criteria for shrubs as well as the success criteria for trees (two separate
success criterion). Therefore, DWC\is not suggesting that EBX in required to plant shrub species as
indicated in the approved BOPO. However, please provide statement explaining why the vegetation
plan did not include shrubs so that iti» well documented, You may use some of the statements |have
provided here if you wish.
Section 4.0
o Third paragraph: please change this statement to exclude shrubs since no shrubs were planted. "The
target density for the riparian buffer isa minimum of32O trees a+d shrubs per acne..."
Conservation Easement (as previously discussed) is not acceptable in its current version, Since the original
easement was provided in the As-Built report, I had to make this comment in my response.
Thanks Tommy. In addition, EBX does not have to resubmit the entire As-Built report after these edits are made. IfE8X
would like to just submit the pages that are affected by the changes, that would be great.
