3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: The existing conditions of a majority of the project includes the construction access road that was utilized
during the Torrence Creek Tributary 2 Stream Restoration project, this restoration project preceded this application. The
general land use in the vicinity of the project is residential.
3b. List the total estimated acreage of all existing wetlands on the property: Wetlands were only delineated within the
proposed greenway corridor for avoidance & minimization purposes so an exact quantity of wetlands in the area is
unknown.
3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property:
Approximately one mile of stream is adjacent to the proposed greenway corridor.
3d. Explain the purpose of the proposed project:
The purpose of the project is to extend the existing Torrence Creek Greenway to Rosedale Shopping Center which is
located within the Northwest quadrant of 1 -77 and Gilead Road, Huntersville, NC. The intent is to provide active
recreation and alternative transportation between existing neighborhoods, open space, schools, and commercial districts.
The proposed greenway is identified for implementation in Mecklenburg County's 1999 -2009 Greenway Master Plan.
3e. Describe the overall project in detail, including the type of equipment to be used:
The overall project consists of approximately 5,000 linear feet of 10' wide asphalt trail with a 12' wide section that
includes maintained grass on both sides of the trail. The proposed trail parallels Torrence Creek Tributary 2 along
the riparian corridor extending from the approximate confluence of Torrence Creek Tributary 2 with Torrence Creek
proper and extends generally northeast along the north side of the stream. Three trail spurs (neighborhood
connectors to Culcairn Rd., Hunters Pointe Dr. & Stawell Dr.) and an undercrossing (located at the new Gilead
Road stream crossing) are proposed for construction along the greenway alignment. Specifically, the greenway
includes the construction of boardwalks, bridges and the re- location of a stream channel under Gilead Road. Equipment
to be used will include excavators, bull dozers and other typical equipment used for land clearing, greenway
construction and excavation.

eastward to a future park near the Rosewood Commons town center. A critical easement for that portion has not
been obtained yet, and financial shortfalls have shelved that part of this Project. It is not known when that part of
the Project will be re- started. More distant conceptual plans call for the greenway to tunnel beneath 1 -77 to reach
the east side of the freeway, but there is little likelihood of that portion being built in the next 5-10 years."

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Prior to designing the final alignment of the greenway the designer contracted Soil & Environmental Consultants to
delineate the jurisdictional wetlands and streams within the area of the preliminary greenway alignment. Based on the
delineation, the greenway alignment has been shifted to avoid and minimize impacts to jurisdictional wetlands and
streams. In addition to avoiding impacts, the project engineer had Soil & Environmental Consultants GPS locate
significant natural elements such as rock outcrops and large diameter trees. As such, the greenway alignment was
modified to avoid negatively impacting these elements. Furthermore, proposed impacts to wetlands and streams are
minimized by utilizing boardwalks and bridges, with exception to Impact #3 (W2) & Impact #4 (S1). Impact #3 is
approximately 152 R2 of permanent wetland fill associated with an arm of the cross -vane necessary for the stream
relocation under Gilead Road. Impact #4 is the proposed stream relocation that is necessary for the greenway trail
undercrossing through the existing culvert bridge. This proposed impact will temporarily impact approximately 180 linear
feet of stream. In addition to the below, please see Appendix 1 for a more detailed justification of this stream relocation
from the project engineer.
"The proposed relocation design for the stream in the vicinity of the Gilead Road crossing utilizes recognized natural channel
design principles consistent with those used in the proposed upstream and downstream restoration project. This approach
develops an appropriate dimension, pattern, and profile for a natural stable channel while simultaneously providing a stable
platform upon which the proposed greenway trail will be located.
Boulder cross -vanes structures are proposed at the entrance and exit of the existing culvert. These structures, in conjunction
with the proposed boulder toe protection along the right channel bank, will be constructed of natural materials typically
consisting of quarried boulders. The upstream side of these structures will be lined with a non -woven fabric where necessary
and backfilled with coarse stone aggregate to improve stability and reduce the potential for piping.
In- stream structures serve to concentrate stream energy toward the center of the channel and away from the near -bank areas
and in the process reduces shear stress along the banks and prevents bank erosion. In- stream structures of this type also
facilitate grade control within the bed of the channel, reduce the potential of head cutting, create a stable width/depth ratio, and
promote sediment transport capacity "
Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 14. With
respect to linear transportation crossings conditions (NWP 14- Regional Conditions section 4.0) stream relocations
will incorporate natural channel design; all streams will be bridged with exception to the relocation under Gilead Rd,
and this project is not being used in conjunction with a NWP 18 to create an upland area.

Where necessary mats will be placed in wetlands for construction equipment traffic. Double rows of silt fence will be
implemented to avoid impacts to wetlands adjacent to the construction corridor.

We have reviewed the "DRAFT Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetland Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. This project
would most likely be considered an "other publically funded development project" and is within an already developed
landscape would not result in cumulative impacts. Additionally, the project is located within the Town of Huntersville
jurisdiction, therefore the adjacent properties that have not already been developed will have the following
regulations to protect downstream waters: 1) the Phase 11 NPDES Stormwater Permit Program, this program
includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -
construction stormwater management requirements; and 2) the Water Supply, Watershed Protection Program
which limits development densities as well as requires protective riparian buffers. We anticipate that the DWQ will
advise us if any additional information is needed.

In May of 2006 S &EC conducted a review of the NC Natural Heritage Program records for federally protected species
within a five -mile radius of the proposed greenway. There were no Federally threatened or endangered species within
the search radius.
Additionally, in 2013 the NC- Natural Heritage Program Map Viewer was used to search for elemental occurrences of state and
federally protected species in the vicinity of the project. It was determined based on the search that there are two elemental
occurrences that have been identified within two miles of the project Gilead Road crossing, which is approximately the center of
the project. These occurrences are listed in a table below.

You have our approval, in accordance with the general certification and those conditions listed below,
to impact 0.064 acre of wetland and 180 linear feet (If) of unnamed tributary to Torrence Creek in order to
construct the greenway in Mecklenburg County, as described in your application received by the Division of
Water Quality (DWQ) on May 3, 2011. After reviewing your application, we have determined that this project is
covered by Water Quality General Certification Number 3820, which can be viewed on our web site at
htto: &2rtal.ncdenr.ong/web/wa/swa/ws /401. The General Certification allows you to use Nationwide Permit
Number 14 once it is issued to you by the U.S. Army Corps of Engineers. Please note that you should get any
other federal, state or local permits before proceeding with your project, including those required by (but not
limited to) Sediment and Erosion Control, Non - Discharge, and Water Supply Watershed regulations.
The above noted Certification will expire when the associated 404 permit expires unless otherwise
specified in the General Certification. This approval is only valid for the purpose and design that you described
in your application. If you change your project, you must notify us In writing, and you may be required to send
us a new application for a new certification. If the property is sold, the new owner must be given a copy of the
Certification and approval letter, and is thereby responsible for complying with all conditions.
In addition to the requirements of the certification, you must also comply with the following conditions:
1. The Mooresville Regional Office shall be notified in vMtIng once construction at the approved impact areas

2. All wetlands, streams, surface waters, and riparian buffers located on the project site where impacts are not
allowed shall be dearly marked (example- orange fabric fencing) prior to any land disturbing activities.
Drainage pattern and hydrology of wetland shall be maintained.
3. Use of native vegetation and other soft stream bank stabilization techniques must be used where practicable
instead of riprap or other bank hardening methods. If riprap is necessary, it shall not be placed in the
streambed, unless approved by DWQ.

4. Storm water discharge structures at this site shall be constructed in a manner such that the potential
receiving streams (of the discharge) will not be impacted due to sediment accumulations, scouring or erosion
of the stream banks.
5. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Preconstruction Notification application. All construction activities
associated with this project shall meet, the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual.
6. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shalt be removed and the natural grade restored within two months of the date the Division of Land
Resources has released the project.
7. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion° form to the 4011Wetlands Unit of the NC DWQ.
8. Continuing Compliance. The applicant (Mecklenburg County) shall conduct all activities in a manner so as
not to contravene any state water quality standard (including any requirements for compliance with section
303(d) of the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ
determines. that such standards or laws are not being met (including the failure to sustain a designated or
achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure
compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure
compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before
codifying the certification,.DWQ shall notify the applicant and the US Army Corps of Engineers, provide public
notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with
15A NCAC 21-1.0504. Any new or revised conditions shall be provided to the applicant in writing, sliall be
provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to Section
404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudic atory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative

Appendix 1: Supplemental Information Regarding the Stream Relocation at Gilead
Road Undercrossing [pertaining to impact #4 in PCN]
Conditions at Gilead Road Undercrossing — The current condition of the stream in the
vicinity of the Gilead Road crossing is poor and is characterized by overly steep and
actively eroding banks. Because of the shading associated with the existing culvert the
banks are generally devoid of vegetation which is further contributing to their instability.
As part of the installation of the greenway trail undercrossing through the existing culvert,
rock cross vanes are proposed for installation immediately upstream and downstream of
the crossing. Cross vanes are intended to provide grade control for the stabilization
reach and protect both sides of the stream -banks within this control reach. These in-
stream structures will serve to concentrate stream energy toward the center of the
channel and away from the near -bank areas thereby reducing shear stress along the
banks and preventing bank erosion through the crossing. Positioned immediately up and
downstream of the crossing the cross vanes also serve as grade control within the bed of
the channel and reducing the potential for head cutting. This type of in- channel structure
has also been shown to improve stream habitat through the creation of a riffle -pool
system, as well as promote sediment transport capacity. Boulder toe protection is also
proposed for the stream along greenway to provide supplemental stabilization of the bank
through the culvert and to protect the proposed greenway trail as it passes under Gilead
Road. Such protection is deemed necessary based on the observed existing conditions
at the crossing which are very unstable. All structures and toe stabilization will be
constructed out of natural materials consisting of quarried boulders. The
upstream /upslope side of these structures will be lined with a non -woven fabric where
necessary and backfilled with excavated channel material or imported stone aggregate to
improve stability and reduce the potential for piping. Disturbed banks within the vicinity of
the work will be lined with erosion control matting (coir matting), applied with the
appropriate seed source and mulched, and over - planted with live stakes to provide
supplemental bank stabilization.
Adjacent Stream Restoration Efforts (by others) — The construction methods proposed in
the vicinity of the Gilead Road Undercrossing including in- channel structures, toe
stabilization, bank stabilization and planting methods are commonly used in stream
restoration and stabilization projects within NC. Similar methods are proposed to be
utilized in the stream restoration project underway immediately upstream of the crossing
along Torrence Creek, Tributary 2.
DWQ / Work in the Dry Requirements — Current plans call for the utilization of a pump
around operation during the proposed in- channel work in the vicinity of the Gilead Road
Undercrossing. As such we anticipate that the proposed bank and channel stabilization
work will be performed In the dry". However based on the size of Torrence Creek
Tributary 2, the contributing drainage area, and conditions at the time of construction
some or all of the work may be performed in wet conditions. Appropriate measures will be
required by the contract to limit erosion and reduce the potential for sedimentation within
the stream.
Appendix 2: Supplemental Information Regarding the FEMA requirements
[pertaining to Section F:8 of PCN]
FEMA/Floodplain Modeling - Hydraulic analysis was performed using the U.S. Army
Corps of Engineers (USACE) River Analysis System (HEC -RAS) computer program and
utilized generally accepted engineering methods. The focus of our study was to model
the stream network and produced data for the 100 -year natural and 100 -year future
conditions profiles. Specifically, it was desired achieving a "no- impact" condition utilizing
the conditions associated with the proposed Greenway Extension Project and associated
pedestrian undercrossing (under the new Gilead Road bridge crossing).
Greenwav in General - The greenway trail was designed by Lappas & Havener, PA
(LHPA) of Durham, NC such that the greenway trail consists of a ten - foot -wide asphalt
path with a twelve- foot -wide section of maintained grass on both sides of the path. This
design was incorporated into the hydraulic models.
Gilead Road Undercrossing - A pedestrian undercrossing was incorporated into the trail
design and added to the hydraulic models at the new Gilead Road crossing location. In
order to accommodate the proposed trail alignment, which is designed to run along the
west (right) side of the stream bank (references to right and left looking downstream), the
stream channel will be shifted slightly to the left beneath the bridge. The greenway trail
(underneath the bridge) at the undercrossing includes a ten - foot -wide reinforced concrete
path along the right side of the channel. A protective quarried boulder lining (with toe
stabilization) along the right channel bank is proposed for bank stabilization and scour
protection. A Floodplain Development Permit (permit # 1509) was issued by Charlotte -
Mecklenburg Stormwater Services on Feb 26, 2009 for the Gilead Road Undercrossing.
Flood Study Results — Hydraulic modeling efforts revealed that the proposed greenway
trail and Gilead Road undercrossing will have no effect on water surface elevations within
the Torrence Creek Tributary 2 hydraulic models. As a delegated study program flood
modeling results and reporting was reviewed and subsequently approved by the
Mecklenburg County Flood Mitigation Program (managed by Charlotte - Mecklenburg
Stormwater Services) in early 2009.
