Subject: REQUEST FOR ADDITIONAL INFORMATION

Dear Ms. Sauer:
On February 27, 2013, the Division of Water Quality (Division) received your application
requesting a 401 Water Quality Certification and Buffer Authorization from the Division for your
project. The Division has determined that your application is incomplete and cannot be
processed. The main issue relates to maintenance of diffuse flow within the Neuse Riparian
Buffers. The application is on -hold until the following information is received:
1. Per the requirements of the Neuse Riparian Buffer Rule, you must show that this site
meets diffuse flow requirements. All new roadside ditches must either:
a. Discharge to existing swales in a manner that does not result in erosion to the
either the swales or stream
b. Be directed to a level spreader - vegetated filter strip or other BMP per Chapter 8
of the BMP Manual (see htto:H portal. ncdenr .orvJweb /wci/ws /su /bmo- manuall.
2. Please provide a BMP Supplement Form with all required items for every BMP that is
proposed on the site per Item (1b) above. BMP Supplement Forms are also available at
the above web site.
3. Please provide full -sized plan sheets that are stamped, signed and dated.

Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 02B .0233 (8), the applicant shall
furnish all of the above requested information for the proper consideration of the application.
If all of the requested information is not received in writing within 30 calendar days of receipt
of this letter, the Division will be unable to approve the application and it will be returned. The
return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee.
Respond in writing within 30 calendar days of receipt of this letter by sending five copies of all
of the above requested information to the Wetlands, Buffers, Stormwater — Compliance and
Permitting (Webscape) Unit, 1650 Mail Service Center, Raleigh, NC 27699 -1650.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for
this activity, and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
