The project has an Individual Permit and corresponding Water Quality Certification (WQC) that are valid until December 31, 2019. Please refer to the attached Table 1 for a complete summary of the permits, water quality certifications and subsequent modifications issued for the project including the impact totals and mitigation requirements. HBP Properties, LLC plans to sell Phase III of the Legend Oak Subdivision to D R Horton, Inc. The new owner plans to construct Phase III of the project in two phases with the first phase containing all three of the proposed road crossings and conservation area required for mitigation as shown on the attached map. We request the USACE modify the Individual Permit to revise the phasing of Phase III and approve the total impacts included within Phase III that will be completed as part of the newly designated Phase III -1. This request also includes replacing the condition of the Individual Permit requiring compensatory mitigation sufficient to perform the restoration of 60 linear feet of warm water stream for the former Phase III -1 with the following revised condition. MAR 18 2013 4 Mr. Matthews March 13, 2013 Page 2 of 3 In order to compensate for impacts to 252 linear feet of stream in Phase III of the project, the permittee shall secure 252 linear feet of warm water stream credits from Cripple Creek Stream & Wetland Mitigation Bank, located in the Cape Fear River Basin, Cataloging Unit 03030002. Work in jurisdictional areas authorized by this permit cannot be initiated until the District Engineer (DE) is in receipt of written documentation, signed by an approved representative of the mitigation bank, confirming that the bank Sponsor has accepted responsibility for providing the required compensatory mitigation in accordance with the approved Mitigation Bank Instrument. This confirmation must include the appropriate number and resource type of credits that have been secured from the Sponsor. It is the Permittee's responsibility to provide this documentation to the DE, and until this documentation has been received, the Permittee retains responsibility for providing all compensatory mitigation associated with this permit. NCDWQ's modification of the Approval of 401 WQC with Additional Conditions on December 21, 2012 included all three phases of Phase III and does not require a modification in order to move forward with mitigation and impacts previously designated as Phase III -2 and 3. Tara Disy Allden of Restoration Systems issued the attached Transfer of Credit Certificate to D R Horton, Inc. for the entire 252 linear feet of stream credits required for Phase III. The applicant proposes to record all conservation areas within Phase III and preserve them in perpetuity during the first phase of the project. USACE's standard preservation language provided for restrictive covenants will be added to Phase III —1 restrictive covenants without modification. The conservation areas are required as mitigation for the proposed impacts and shown on the Legend Oaks Subdivision Phase III - Draft Stream Preservation Map dated and provided to the USACE on September 7, 2010. Mr. Brantley Powell supplied D R Horton with copies of the Individual Permit, modifications and 401 WQC approvals that are applicable to Phase III and informed them that conservation areas must remain in their natural, undisturbed state prior to recordation for their use as mitigation in the future. We request the USACE replace the preservation mitigation condition of the Individual Permit with the following revised condition. Permittee shall execute and cause to be recorded in the Chatham County Register of Deeds restrictive covenants for Legend Oaks Phase III -1 as described in your letter (from Jennifer Burdette, Burdette Land Consulting, authorized agent) dated March 13, 2013, for the purpose of maintaining the restrictive covenants, as shown on the recorded plat (properly recorded and showing preservation areas), in their natural state in perpetuity, prior to the sale or conveyance of any lots or other property within Legend Oaks Phase III -1 or by December 31, 2014, whichever comes first. The permittee shall enforce the terms of the restrictive covenants and, prior to conveyance of the property, shall take no action on the property described in the covenants inconsistent with the terms thereof. (`Buyer') and Restoration Systems, LLC a North Carolina limited liability company ( "RS's, certifies and acknowledges Transfer of Stream and Wetland Mitigation obligations, as follows: WITNESSETH In consideration of the covenants and considerations recited herein: 1. By signature of this Certificate, RS hereby transfers to Buyer 252 stream credits from the Cripple Creek Stream Mitigation Bank located in Alamance County, Cape Fear River Basin, and Cataloging Unit 03030002 and authorized by the Interagency Review Team (IRT) pursuant to the Cripple Creek "Mitigation Banking Instrument" (MBI) dated January 19, 2010 (Bank). The credits transferred by this Certificate are intended to satisfy compensatory mitigation requirements for aquatic resource impacts authorized under Section 404 of the Clean Water Act by the United States Army Corp of Engineers (CORPS) Permit SAW -2009- 00106 (Permit) and under Section 401 of the Clean Water Act by the Department of Natural Resources- Department of Water Quality (DWQ) Certification # 2005 -1986 (Certification). CORPS and /or DWQ have acknowledged and agreed that use of credits from the Bank may be used by Buyer to satisfy the compensatory mitigation requirements established by the Permit and Certification (the Compensatory Mitigation Requirements) and that upon the presentation of this signed Transfer Certificate by RS to Buyer, and the delivery to CORPS /DWQ a copy of this Certificate of Transfer along with an Official Credit Ledger and the COPS' Compensatory Mitigation Responsibility Transfer Form, that all obligations with respect to the Compensatory Mtigation Requirements, shall be the' sole responsibility of RS. 2. RS acknowledges that Buyer has made full payment to the Cripple Creek Mitigation Bank and agrees to fulfill the Compensatory Mitigation Obligations. 3. Upon execution of this Agreement, RS shall forward an original of same to CORPS and DWQ. 4. RS certifies that mitigation credits are immediately available to Buyer and that all conditions relating to providing the transferred of mitigation obligation outlined in Buyer's Permit Action.
