Dear Mr. Brown:
Please reference your, February 22, 2013, request (enclosed) to modify our,
July 28, 2010, Department of the Army authorization to the Western Wake Partners (Partners) to
permanently impact 0.82 acre of wetlands and 378 linear feet (If) of stream (232 If of perennial
and 146 if intermittent) in order to construct and operate the new wastewater management
facilities including influent conveyance facilities, a new water reclamation facility, and new
effluent conveyance facilities in western Wake County, North Carolina. The proposed
modification is to perform an open -cut intermittent stream crossing instead of a directional bore
crossing at the Western Wake Regional Wastewater Management Facility site. The proposed
open -cut stream crossing will temporarily impact 40 linear feet of stream. No mitigation is
proposed for the temporary impacts to the stream.
As stated in your letter the reason you are making this request is because the effluent
pump station contractor's tunneling subcontractor has gone bankrupt, and a new contractor is
expected to cost substantially more than what was bid and potentially delay the project
significantly.
After reviewing your request I have determined that your proposal continues to be
consistent with the provisions and conditions of your Department of the Army permit and is
hereby modified to reflect the aforementioned changes. It is understood that all other conditions
of your permit remain applicable and that the expiration date is, December 31, 2015.
Please remember that all work authorized by this permit must be performed in strict
compliance with the attached plans, which are a part of this permit. Any modification to these
plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation.

Request for Permit Modification, Western Wake Regional Wastewater
Management Facility, Wake County, North Carolina
Dear Mr. Wicker:
The Western Wake Regional Wastewater Management Facility (the permittee) hereby
requests authorization of a modification to the permit issued for the subject project under
the United States Army Corps of Engineers (USACE) Action ID SAW- 2005 - 20159. The
permittee proposes a modification to the design of one stream crossing at the Western
Wake Regional Wastewater Management Facility ( WWRWMF) associated with the
subject permit. The permittee formally requests consideration to open -cut a stream on
the WWRWMF site in order to install the 64 -inch plant effluent line and 4 -inch drain line
shown on the attached Sheet G -17. The Effluent Pump Station contractor's tunneling
subcontractor has gone bankrupt, and a new contractor is expected to cost substantially
more than what was bid and potentially delay the project significantly. The table below
and attached figures depict the impacts associated with an open -cut installation and
include only the waters of the US that are proposed to be impacted by the WWRWMF
site portion of the project.
Impacts to jurisdictional streams that are currently permitted for the WWRWMF and
associated infrastructure project include 408 feet of permanent impacts (242 feet of
perennial and 166 feet of intermittent channel) and 1,878 feet of temporary impacts (984
feet of perennial and 894 feet of intermittent channel). No impacts to streams have been
permitted within the WWRWMF site portion of the project. If the design modification is
authorized as requested, temporary impacts to intermittent streams will increase by 40
feet. No change in the length of stream proposed to be permanently impacted will occur
due to the design modification.
