Skvarla, III Governor Director Secretary March 18, 2013 DWQ Project # 06 -1804 v3 Johnston County Riverdell Company Attn: Ms. Rebecca Flowers 4880 NC Highway 42 East Clayton, NC 27527 Subject Property: The Village at Flowers Plantation — POD NW8 UT to Mill Creek [030402, 27 -39, WS -IV, NSW] APPROVAL OF STORMWATER MANAGEMENT PLAN Dear Ms. Ms Flowers: On March 5, 2007, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification and Authorization Certificate per the Neuse River Buffer Protection Rules (15A NCAC 2B.0233) to place fill within or otherwise impact the following: Type of Impact Amount Approved (units) 404 /Wetlands 0.122 (acre) — permanent 404/Wetlands .0005 (acre) —temporary Stream — perennial 868 (If) — permanent Stream — perennial 160 (If) — temporary Stream — intermittent 416 (If) — permanent Buffer —Zone 1 79,584 (so Buffer — Zone 2 39,603 (sf) In order to meet Condition 9 (stormwater management) of the Water Quality Certification and Buffer Authorization for this project, a stormwater management plan (SMP) for Pod NW8, dated February 1, 2013, was received on February 8, 2013. The DWQ approves the SMP for Pod NW8 as meeting Condition 9 of the Water Quality Certification and Buffer Authorization. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new diffuse flow plan. The SMP approved by the DWQ consists of one (1) grassed bioretention cell and all associated stormwater conveyances, inlet and outlet strictures, and the grading and drainage patterns depicted on plan sheets dated December 21, 2012. The plans and specifications for Pod NW8 approved by DWQ are incorporated by reference into this approval and are enforceable by DWQ, provided however that any modification of the design for the bioretention cell that is accepted by DWQ shall take precedence over the original plans and specifications. 3. The maximum allowable drainage area for the approved bioretention cell shall be 330,620 square feet and the maximum allowable built -upon area within that drainage area shall be 115,717 square feet. Built -upon area includes, but is not limited to, roofed structures, asphalt, concrete, gravel, brick, slate, coquina and parking areas, but does not include raised, uncovered open slat decking or the water surface of swimming pools. Any changes to these maximum areas shall require the applicant to submit and receive approval for a revised stormwater management plan by the DWQ. 4. The footprint of the bioretention cell as well as an additional 10 -foot wide area on all sides of the devices shall be located in public rights -of -way, dedicated common areas or recorded easement areas. The final plats for the project showing all such rights -of -way, common areas and easement areas shall be in accordance with the approved plans. 5. Maintenance activities for the bioretention cell shall be performed in accordance with the notarized 0 &M agreements signed by you on January 10, 2013. The 0 &M agreement must transfer with the sale of the land or transfer of ownership /responsibility for the BMP facility. DWQ must be notified promptly of every transfer. 6. The applicant and /or authorized agent shall provide a completed Certificate of Completion form to the DWQ within thirty (30) days of project completion (available at http: / /porta I. ncde nr.ore/ web /wq /swo /ws /401 /certsandpermits /apply /forms).
