ADDITIONAL CONDITIONS
3) The riprap material shall be free from loose dirt or any pollutant It shall -be of a size sufficient to., §
prevent its movement from the approved alignment by wave or current,actiori
4) The concrete pad shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure Live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State
Sedimentation and Erosion Control
5) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters_
6) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands,-watercourses and, property (e g silt fence; ti
diversion swales, etc) -
General
7) No new vegetated wetlands shall be excavated or filled _
8) In order to protect anadromous fish spawning, no in -water work shall be permitted between February 1
and September 30 of any year without the prior, approval of the Division ,of Coastal Management, in
consultation with the N C Wildlife Resources Commssion
NOTE: In consultation with Wildlife Resources Commission, a two week extension into -the in -water
work moratorium referenced in Condition No 8 is granted for the 2013 work lseason only. The 3
v_ moratorium dates referenced in Condition No` 8 shall remain in place -for all subsequent years
9) -The permittee and /or his contractor shall meet with a representative of the Division prior to project,,,
initiation

10) = This minor modification shall be attached to the original Permit No 94 -12, which was issued on 8/7/12,
;and copies of all- documents shall be readily available on site when Division personnel inspect-the y
broiect -for compliance
11) All conditions and stipulations of the active permit remain in force under this minor modification-unless-
specifically altered - herein _ ;
