HomeMy WebLinkAbout20011551 Ver 5_Other Agency Comments_20130218CO- ISSI VS DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVENUE WILMINGTON, NORTH CAROLINA 28403 -1343 February 15, 2013 REPLY TO ATTENTION OF Kegulatory Division/1200A Action ID- SAW- 2011 -01765 NC Granite Corporation Attn: Mr. Kenny Moles 151 Granite Quarry Trail Mount Airy, North Carolina 27030 Dear Mr Moles- Reference the Department of the Army (DA) permit issued to you on September 14, 2012, which authorized the permanent placement of 600 cubic yards of fill material and 1,680 cubic yards of granite within the Ararat River, and the dewatering of 540 linear feet of stream channel to a side channel These impacts are associated with the long -tern solution to supply water for future granite quarry operations. The project site is located within the Ararat River, adjacent to the existing North Carolina Granite Corporation Quarry, north of Mount Airy in Surry County, North Carolina The site is found at Latitude and Longitude in Decimal Degrees of 36.510 °N and - 80.592 °W, and is within the Yadkin River Basin (HUC 03040101) Reference is also made to your letter dated January 29, 2013, requesting an additional permitted impact within the existing holding pond Your request includes an additional 0.014 acre of permanent open water impact from the installation of a closed inlet structure and 30 linear feet of temporary open water impact from dewatering during construction This structure will allow the holding pond to maintain a normal pool elevation and maximize water recycling at the quarry. Plans showing this additional impact were included with the request. Lastly, reference an email from Mr Michael Wood of The Catena Group, authorized agent, received on February 8, 2013, which indicated that installation of the pipe through the 600 cubic yards of permitted fill would be completed on or before April 1, 2013. This pipe is intended to supply hydrology to the nearby side channel and eliminates the need for additional compensatory mitigation. It is understood that you are agreeable to modifying the permit condition to include this target date. The Corps has completed the evaluation of your request and concurs with your request for a change in impacts associated with your referenced DA permit, including the change to plans as requested No compensatory mitigation is required for this modification. In addition, Special Condition "e" is hereby modified to rea FF19 1 8 2013 D NR - WAi ER (iUfa1 IT1 -2- e) Installation of the 2" pipe will be completed on or before April 1, 2013. The side channel below the 2" pipe discharge shall be measured for hydrologic flow and visually monitored in February and August each year for two years post construction This monitoring will be for loss of hydrologic function/flow and to determine if the stream continues to provide aquatic life propagation and biological integrity. Annual monitoring reports, photographic documentation, and measured flow amounts shall be submitted to the Corps, Raleigh Field Office within 60 days of each monitoring period. If flow is found to be less than the expected 26,500 gallons per day, compensatory mitigation may be required at the discretion of the Corps. It is understood that all other conditions of the permit, including the permit expiration date, remain applicable.
