Wetlands
On September 21, 2012, the Corps of Engineers received an application from you requesting
authorization to modify your existing permit issued to you June 11, 2012 for permanent impacts
to 1 11 acres of Section 404 jurisdictional wetlands to complete the development of the Village
at Motts Landing residential subdivision The modification requests impacts to an additional
0.12 acres for the construction of three single family dwellings. The 262 acre project is located
along River Road and the north side of Sanders Road, New Hanover County, North Carolina
The Corps has received three (3) written responses to the Public Notice issued November 20,
2012. The following comments have been received from state and federal agencies and the
public
1 On December 18, 2012, our Office received an email from North Carolina Division
of Water Quality stating that they had no comment to the Public Notice
2 By letter dated December 20, 2012, the United States Fish and Wildlife Service stated
that they have no objection to the activity as described in the permit application
On December 20, 2012, our Office received an email from an adjacent
landowner who received a copy of the Public Notice Ms Loretta Thomas, on behalf
of the Sanders Family, expressed concerns that the filling of wetlands may negatively
impact their property and /or sale of their property The Corps responded to this email
on January 2, 2013 stating that the discharge of fill material into the requested 0 12
acre areas should not have an effect on the property
According to the above, there were no comments that required a response from you or your
consultant, Southern Environmental Group, Inc In summary, the Corps is prepared to make
final decision on your project Please keep in mind that a DA permit will only be granted if the
District Engineer determines that it would not be contrary to the public interest based on an e-
valuation of the probable impacts, including cumulative impacts, of the proposed activity and

its intended use on the public interest (33 CFR 320 4(a)(1)) Provisions under the National
Environmental Policy Act (NEPA) require consideration of reasonable alternatives, which would
allow the project to be accomplished based on the project's purpose and need A final permit
decision will be issued from our Office in the next 30 days
