Section 401 Water Quality Certifications for the Bowers to Lake Rail Improvements

Dear John,
As you know, the North Carolina Department of Transportation (NCDOT) Rail Division (Rail
Division) has proposed railroad improvements to approximately 4.2 miles of rail within the
North Carolina Railroad Company (NCRR) /Norfolk Southern Corporation (NS) railroad corridor
extending from station "Bowers" to a point approximately 250 feet south of station "Lake" in
Davidson County. The project area associated with the C -4901 project encompasses
approximately 183.3 acres and generally consists of the area within 100 feet of the center of the
existing railway and outward along Upper Lake Road (State Route [SR] 2024) and Turner Road
(SR 2005). Along these roadways, the project area extends up to 1475 feet from the existing rail
line with widths that range from 75 to 350 feet from the roadway center.
An application for authorization to impact areas subject to Section 404 jurisdiction was
submitted in January 2013, and was placed on Public Notice from January 29 to February 28,
2013. Subsequent to permit submittal, the Rail Division was requested by the NCDWQ to revise
stream impact calculations using more accurate stream locations. The locations of streams
determined to be jurisdictional were refined using a combination of detailed topographic
mapping and field surveys.

Please note that all changes to impacts are due to the refinement of stream length calculations
based on surveyed /modeled streams, with the exception of changes to impacts at Site 12 (please
see the attached permit drawings, Sheet 12). Site 12 has the most significant increase due to a
slight revision of design plans as requested by the NC Railroad Company to remove the existing
culvert under the rail and direct drainage to the existing stream via ditch to avoid future
maintenance issues; however, the proposed revision falls entirely within the existing project
footprint. At this site, design revisions result in approximately 17 feet of additional impact, and
the recalculation of stream lengths results in approximately 46 additional feet of impact. The
following table summarizes changes to stream impacts.

The length of streams impacted by this project has been recalculated to total 1245 linear feet, an
increase of 91 linear feet from previous calculations. The recalculation of stream lengths
accounts for approximately 74 feet of additional permanent impacts, and the design revision at
Site 12 accounts for the remaining 17 feet of additional permanent impacts. Some slight changes
to temporary impacts at individual sites were calculated; however, total temporary stream
impacts due to this project have not changed.
