Dear Mr. Wilson:
The Rocky Point Quarry 401 Water Quality Certification (DWQ Project s 2003 -1023, Certification
3452) was issued on March 15, 2004, and subsequently revised in response to modification
requests dated May 14, 2004 and May 20, 2004.
With respect to the modification request from Kimley -Horn and Associates, Inc. dated February
26, 2013, it is agreed by copy of this letter that 401 Water Quality Certification # 3452, dated
March 15, 2004 and modified on May 14, 2004 and May 25, 2004, is modified to reduce the
monitoring east of the quarry where mining activities have ceased and reclamation is
completed (see attached aerial). This also includes ceasing the discharge to Strawberry Branch.
Martin Marietta Rocky Point Quarry is required to continue the monitoring per the
Modified Alternative Pumping Plan south of the active mine. All other certification and
conditions remain unchanged and are in effect.

Dear Ms. Steenhuis:
On behalf of our client, Martin Marietta Materials (MMM), Kimley -Horn &
Associates (KHA) is submitting this request for a modification to the existing
401 Water Quality Certification for the Rocky Point Quarry project referenced
above. This requested change to the 401 Certification conditions is made per our
onsite discussion held on January 29, 2013 and MMM's requests to reduce the
monitoring east of the quarry where mining activities have ceased and
reclamation is completed.
The 401 Certification requires the Modified Alternative Pumping Plan to be
implemented throughout the time the facility is actively mining and conducting
measures necessary to reclaim the mine footprint. This includes creating a
hydrologic barrier to subsurface drainage from the eastern parcels (H1,H2 and
the avoided portions of G1); the redirection of a portion (1/3) of the dewatering
discharge currently directed to Strawberry Branch to the drainage way east of the
mine between H1 and H2. The 401 Certification also required maintaining
hydration to the western portion of Tract G2 throughout the time the facility is
actively mining. Based on our site visit, we agreed that the areas listed above
are no longer being actively mined and should no longer be subject to the
Modified Alternative Pumping Plan. Therefore, MMM proposes to continue
monitoring per the Modified Alternative Pumping Plan south of the active mine
and cease monitoring east of the reclaimed portion of the mine as shown in the

attached figure. In addition, MMM will cease discharge to Strawberry Branch.
The permanent water body within the reclaimed pit will provide a hydrologic
barrier to the eastern properties while mining activities move southward and
further from the eastern tracts.
With these monitoring and discharge changes implemented, MMM can proceed
with coordination with NC Division of Land Resources to have the reclaimed
portion of the mine site released from the mining permit and document that
reclamation has been completed, thereby turning the property back to the
management and control of the property owners.
