Axiom Environmental, Inc. has prepared a permit application on behalf of the NCDOT Rail Division and would like to request the appropriate mitigation from the N.C. Division of Mitigation Services.  This project is the Salisbury Train Station Second Platform and Pedestrian Underpass in Salisbury, Rowan County (NCDOT Division 9), TIP No. P-5726.  All project impacts occur within 8-digit HU 03040103 (NCDWR sub-basin 12-115-3 of the Yadkin Pee Dee River basin).  Permanent impacts total 175 linear feet of streams and no wetlands. o Of the stream impacts, 132 feet will be placed in a culvert and 43 feet will receive bank stabilization. o Coordination with the U.S. Army Corps of Engineers (USACE) has resulted in the USACE requiring mitigation for the 132 feet of stream to be placed in a culvert and no mitigation for the 43 feet receiving bank stabilization. We have provided the USACE with documentation that the stream proposed for impacts is of poor quality with low function. As a result, the USACE has agreed to accept 1:1 mitigation for 132 linear feet of stream.  The mitigation requested totals are 132 warm-water stream mitigation credits.  Our USACE contact is Andy Williams of the Raleigh Regulatory Field Office (Andrew.E.Williams2@usace.army.mil), and our NCDWR contact is Dave Wanucha of the Raleigh Regional Office (Dave.Wanucha@ncdenr.gov).  Please address the mitigation acceptance letter to Mr. Matthew Potter, NCDOT Rail Division (mwpotter@ncdot.gov, 1553 Mail Service Center, Raleigh, NC 27699-1553). Based on the information supplied by you on May 20,2021,the impacts are located in CU 03040103 of the Yadkin River basin in the Central Piedmont(CP)Eco-Region,and are as follows: Stream Wetlands Stream and River CU Eco- Wetlands Basin Location Region Cold Cool Warm Riparian Non- Coastal Riparian Marsh Impacts Yadkin 03040103 CP 0 0 132.0 0 0 0 The impacts and associated mitigation needs were not projected by the NCDOT in the 2021 impact projection data. DMS commits to implementing sufficient stream mitigation credits to offset the impacts associated with this project as determined by the regulatory agencies in accordance with the In-Lieu Fee Instrument dated July 28,2010. If the above referenced impact amounts are revised,then this mitigation acceptance letter will no longer be valid and a new mitigation acceptance letter will be required from DMS.
