On behalf of the Town of Holly Springs, we are requesting authorization from the
USACE to use NWP 39 for 65 linear feet of permanent impacts to jurisdictional streams.
The project is ±5 acres in size and is located on a 17.48 acre parcel southwest of the
intersection of Avent Ferry Road and West Earp Street, in Holly Springs, Wake County
(Latitude: 35.652049N; Longitude: - 78.835992W). The project is located in the Cape
Fear River basin and onsite waters drain to Utley Creek. The Water Quality
Classification for Utley Creek is C and the Stream Index Number is: 18- 7 -5.5.
Proposed Project
The proposed project consists of a town park including a regional stormwater control
structure. The proposed regional stormwater control structure will provide stormwater
treatment for a ±25 acre drainage area within Holly Springs, which will result in
improvements to the downstream water quality of Utley Creek.
Project History
Mr. James Lastinger with the Corps of Engineers issued a Jurisdictional Determination
(AID# SAW- 2012 - 00088) for the subject property on February 1, 2013. A copy of the
jurisdictional determination is included with this submittal.

Proposed Impacts
The proposed impacts consist of 65 linear feet acres of permanent stream impacts as a
result of construction dissipater pads at the outlets from the stormwater control structure.
Additional rip -rap will be placed on the banks of the stream, beyond the impact area at
Impact 2 to provide stabilization of the failing stream banks. The rip -rap will be placed
above the 100 -year flood elevation, which is also above the ordinary high water elevation
of the stream, to provide additional stabilization during high flow events. The placement
of the rip -rap above the ordinary high water elevation of the stream will not result stream
impacts.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed stream and wetland
delineation be conducted to identify the jurisdictional features within the proposed
project.
The project site is located in the headwaters to Utley Creek. The onsite wetlands consist
of very small wetland pockets along the defined stream channel. The design of the
proposed plan uses retaining walls to avoid impacts to the wetlands located in the vicinity
of the project area.
The stream impacts are limited to 2 dissipater pads located downstream of the proposed
impoundment. The impoundment is located upstream of all jurisdictional areas. The
impoundment outlets discharge into 2 of the three fingers of the creek. The creek will be
fed by these outlets as well as through groundwater recharge. The existing creek has
areas with severe erosion and vertical side slopes. As part of this project, the stream
banks will be stabilized with natural materials to prevent further erosion of the channel.
Mitigation
Total stream impacts are less than 150 linear feet, therefore no mitigation is proposed.
Stormwater Management Plan
The proposed project will result in <5% impervious area onsite but will facilitate
additional development in the upstream watershed. The stormwater control structure is
desined to control and treat runoff from the entire watershed including both existing and
future development. The stormwater management plan consists of the treatment of
stormwater runoff in a cistern and constructed wetland. The Stormwater Management
Permit application will be submitted to the Town of Holly Springs for review. A copy of
the Town of Holly Springs final approval of the Stormwater Management Plan will be
provided to DWQ upon issuance.

The existing site is undeveloped and wooded. The site is located in the northwest portion of downtown Holly Springs.
Surrounding land uses are a mix of residential, commercial, and town buildings. The project site is approximately 4 acres
of the 17.48 acre parcel. the remaining parcel area is to become a town park at a future date.

The project proposes construction of a regional stormwater device to provide water quality benefits and flood control for
downtown Holly Springs. Townhome lots will be established along Earp Street but will not be developed at this time. The
project is part of the Mims Park project and will include greenway trails, streetscape, and culvert improvements under
Avent Ferry Road.

The project will be built with heavy grading and excavation equipment. The construction includes roadway, culvert, and
retaining wall construction.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The layout of the project considered the impact to stream and wetland and located all park features outside of jurisdictional
areas. The proposed impacts have been limited to impacts necessary for construction of the rip -rap dissipater pads for the
BMP outfall, which are necessary to reduce outfall flow velocity to prevent erosion of the streams. Also, a retaining wall will be
used to stabilize road fill adjacent to the streams to minimize stream impacts. The project will provide water quality benefits
for a 25+ acre drainage area and accounts for future development within the basin.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The proposed stormwater control structure has sufficient volume to control runoff from over 3" of rainfall during construction.
The temporary outlet structures will be designed to slowly dewater the basin while also filtering the stormwater to remove
sediment and silt. Existing wetland will be protected with silt fence and tree protection fencing at all times. Construction of the
dissipater pads will also include streambank stabilization measures to prevent continued erosion.

The Proposed BMP serves as an offsite stormwater control devices for upstream development; as such, a stormwater
management plan is required by the Town prior to approving construction drawings for any upstream development. The

TSS removal, 40% nitrogen removal, and 40% Phosphorous removal for the entire watershed, including the project site.

The project is a regional stormwater control structure designed to facilitate high density development within the
contributing watershed. Downtown Holly Springs contains few undeveloped parcels and based on field visits is not
