Skvarla, III Director Secretary February 25, 2013 County: Columbus Project Name: Garrell Farm (5275 Chadbourn Highway, Chadbourn, NC) Subject Feature (s): This feature is located at the above address in the south central portion of the site. It drains flow from an upland wet area southward around a man -made pond towards a rail line located just south of the property line. The feature then flows west in the ditch parallel to the rail line until it reaches Soules Swamp. See attached maps for detail. Date of Determination(s): 01/16/2013 Feature Notes /Basis for Call (Stream Form Rating, Biol. Location Indicators, etc.). 1 Non - stream feature labeled as (SA 1 -26) The feature is a man -made ditch that directs flow around adjacent to pond (PA 1 -11) as shown on attached a man -made pond inio SOUles Swamp. map. This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local may request a determination by the Director. An appeal request must be made within sixty (60) days of the date of this letter or from the date the affected party (including downstream and /or adjacent owners) is notified of this letter. A request for a determination by the Director shall be referred to the Director in writing c/o Karen Higgins, DWQ Wetlands /401 Unit, 1650 Mail Service Center, Raleigh, NC 27699 -1650. This determination is final and binding unless as detailed above, you ask for a hearing or appeal within sixty (60) days. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699 -6714.
