John Lare Page 2 PROJECT DESCRIPTION: The applicant has requested that the subject LAMA Major Permit application be processed under the Express Review Permitting Program. The project site is located at 1839 Middle Sound Loop Road, adjacent to the Atlantic Intracoastal Waterway (AIWW), in Wilmington, New Hanover County. The property is approximately 2.33 acres with roughly 218' of shoreline frontage, and averages 2-12'above mean high water in elevation. Asingle-family residence is centrally located on the property. High ground vegetation on the site consists of Live Oak, Pine and Maple. Understory vegetation, located along the northern and eastern property line, consists of Wax Myrtle, Baccharus, Yaupon and Cedar. Coastal marsh species, including Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.), Salt Meadow Grass (Spartina patens) and Smooth Cordgrass (Spartina Alterniflora) are located immediately east of the Understory/transitional species. To find the property, take Highway 17 North from Wilmington and turn right onto Middle Sound Loop Road in Ogden. Continue along Middle Sound Loop Road (approximately 2.0-2.5 miles) until you see 1839 Middle Sound Loop Road, which will be located on the left hand side of the road in a sharp curve. The New Hanover County Land Use Plan classifies the adjacent waters as Conservation and the adjacent high ground portion as Developed. The waters of the APJVW, in the vicinity of the project area, are classified SA-ORW by the N.C. Division of Water Quality. They are designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are Open to the harvest of shellfish. The property owner obtained a CAMA general permit (GP#38538) on 4/17/07, for the construction of a 6' x 400' access pier. The access pier is currently being constructed under the general permit, however the applicant is requesting approval under the LAMA Major Permit process for continued development beyond 400'. PROPOSED PROJECT: Proposed development includes the addition of approximately 60' of access walkway/pier beyond what was previously permitted (6' x 400'). The applicant is also requesting to install a 16' x 30' "L-Head" shaped platform at the end of the access pier that would span towards the south. A 16' x 16' covered gazebo would be centrally located within the footprint of the platform, leaving the northern and southern portions uncovered. Located along the northern side of the access pier, the applicant proposes to construct an 8' x 8' fixed finger pier that would provide access to the proposed floating dock. The floating dock (8' x 48') would run parallel to the access pier and terminate in the same alignment as the platform, just landward of the existing pier-head line. Three boatlifts (14' x 16') would be constructed adjacent to the pier structure, one located just landward of the proposed 8' x 8' finger pier (labeled on the workplan drawings as H3), one located on the northern side, and at the terminal end of the proposed floating dock (labeled as H1) and one on the southern side of the terminal platform (labeled as H4). A total of four slips are proposed. Water depths in the vicinity of the proposed boatlifts range from -2.0' to -4.0' below Normal Low Water (NLW). According to the work plat drawings provided by the applicant's agent, the proposed structure would be located within '/4 of the width of the waterbody, within the established pier-head alignment and outside of the U.S. Army Corp of Engineers channel setback. Additionally, the applicant can avoid any impacts to the adjacent property owners by working within his established riparian corridor. 10. ANTICIPATED IMPACTS The proposed pier, platform, finger pier, floating dock and boatlifts would result in the shading of approximately 1,860 sq. ft. of "404" and coastal wetlands and would incorporate approximately 4,204 sq. ft. of estuarine waters and public trust areas. Minor increases in turbidity can be expected during construction.
