PROJECT SUMMARY: The project is being proposed as a major modification to Major Permit #97 -05. The project area was previously the location of Ottis fish house and restaurant. The existing major permit was permitted for a five -story residential and commercial structure with parking deck and a 10 -slip docking facility. It was permitted based on a declaratory ruling that was issued by the CRC on 5/8/03. There is no high Field Investigation Report: Town of Morehead City (Otis Landing) Page 02 ground work proposed through this modification request due to the fact that it was previously permitted through minor permit #01 -13 for the replacement of the existing road and fountain construction. The applicant is proposing to construct a municipal pavilion called Ottis' Landing. The pavilion would be equipped with public restrooms and open deck, an observation deck, and a 10 -slip public docking facility. It would be constructed in three phases. 9. Narrative Description The Town of Morehead City Otis Landing project is located along the Morehead City waterfront (designated as urban waterfront area) within the Morehead City Harbor area of Bogue Sound at 705/707 Shepard Street. The tract is bordered by Capt. Bills restaurant to the east and privately owned boat docks to the west. The Town of Morehead property is 14,310 square feet (.33 acres) in its entirety, has a shoreline length of 129' and is an average of 3' above NHW. Presently there is an existing bulkhead, sidewalks, street and old pilings from the old Ottis fishouse on and along this tract. There are no coastal wetlands or high ground vegetation on this tract. The Morehead City Land Use Plan classifies this property as Downtown Mixed Use, with all AEC's classified Conservation. This section of the Bogue Sound (Morehead City Harbor) is not designated as Primary Nursery Area, is closed to the taking of shellfish and carries a water classification of SC. The historic riparian corridors were determined through the original permit # 97 -05 and shall pertain to the newest proposal and meet all required setbacks. Substrate in the Morehead City Harbor is mostly sand and silt. No SAV's or shellfish beds were observed within the proposal project area. There is a USACOE federal within the project vicinity. 10. Proiect Description: The existing major permit # 97 -05, which was issued on 7/1/2005, authorized a five - story residential and commercial structure with parking deck and 10 -slip docking facility. A transfer was issued on 6/5/2009 to NC Coastal Land Trust as well as on 6/9/2010 to the Town of Morehead City. The applicant's current proposal is to construct a pavilion with restrooms and open deck, observation deck and a 10 -slip docking facility. Phase 1 of the project would be the construction of a 12' wide x 12' long (144 sf) observation deck parallel to the shore along the existing bulkhead. This phase would begin immediately following the issuance of a modification approval from DCM. The observation deck would connect to the pavilion by way of two sets of steps. The steps located along the center of the pavilion would be 22' x 14' (308sf) with a maximum elevation of 10' above the existing bulkhead. The smaller steps to the west side of the pavilion would be 6' x 10' (60so with a maximum elevation of 10' above the existing bulkhead too. Phase 2 would be the construction of the decking for the pavilion, which includes the open deck area, the restrooms and the 10 -slip docking facility. The applicants are proposing a total open deck area of 6,641 square feet (approximately 70' x 95') for the pavilion Field Investigation Report Town of Morehead City (Otis Landing) Page 3 decking. A total of 770 square feet (approximately 16' x 46') of the non open deck area would be restroom. The total roof area for the restroom would be 1,445 square feet or approximately 30' x 48'. The women's and men's restrooms would be located along the north east side of the pavilion extending approximately 20' waterward of nhw. The entire pavilion would be placed within the previously permitted building footprint of 9,951 square feet. The pavilion would have a 6' x 89' ramp along the eastern side of the restrooms. The ramp would extend from the existing bulkhead to the pavilion and intersect the south east open deck area. The pavilion would be located a distance of 10' from the riparian corridors. The original permit allowed for encroachment of the building within the corridors without waivers. The final portion of phase 2 is the construction of a 10 -slip docking facility for public and transient use. There would be a side -to fixed 6' x 28' landing along the south side of the pavilion. A gangway would extend from the fixed landing south to intersect with the proposed floating 8' x 47' floating pier. The pier would intersect with a floating 6' x 88' floating t -head. Slips 1 -4 would be located along the west side of the floating pier and would house a total of 6 tie pilings that would delineate the slips. Slips 5 and 6 would be located on the south side of the floating platform and would be side -to. The remaining slips (6 -10) would be located along the east side of the floating pier and would also house a total of 6 tie pilings that would delineate each slip. The water depths within the slip areas are an average of - 3.55'at normal low water. The tidal amplitude within this area is 3.08'. Through conversations with the applicant the wider pier width is needed for handicap access, safety and public access. The total length of the shoreline is 129.18'. The waterward edge of the proposed platform would be located a distance of 22 feet from the USACOE setback. The width of the Morehead City Harbor is approximately 530' in this area. The proposed pier would extend a maximum of 133' waterward of nhw within a 530' wide waterbody. According to the applicant, the typical boat would be 20'with a mixed use open runabout design. The marina policy would prohibit overboard discharge, no fueling and no overnight or live aboard dockage. There would be a total of two "No Sewage Discharge" signs located along each end of the dock. The final and 3`d phase of the project is the addition of the roof over the pavilion area. A total of 5,014 square feet of roof would be added to the decking constructed during phase two of the project. The roof square footage would include the restroom area as well. The 12' wide observation deck and parts of the pavilion open deck area would remain uncovered. There is no impervious surface impacts due to the project is entirely over estuarine waters. 11. Anticipated Impacts: The proposed pier and platform would shade 1,072 ft' and incorporate 2,816ft2 of open waters. The setting of pilings would cause temporary turbidity. There would be no hindrance to navigation due to the fact that the docking facility would be located a distance of 22' landward of the USACOE channel setback. The width of the pier would be greater than six feet however per 7H.0208 (6) (A) could be permitted if the greater width is necessary for safety or to improve public use access. The applicant has stated in past conversations that the 8' width is necessary for use by the public and ADA accessibility safety. The total pier length, which includes the platform, would be a distance of 133'within a 530' wide waterbody. The pavilion area would shade a total of 8,542 Ft2 and Field Investigation Report: Town of Morehead City (Otis Landing) Page 04 incorporate a total of 9,120 Fe of open water and has the potential to cause temporary turbidity during construction. This project has the potential to improve public benefit by adding additional public access. There is the potential for future dredging however none is proposed at this time. Name: Heather Styron Date: 3/1/13 Morehead City PROJECT NARRATIVE — MODIFICATION OF CAMA MAJOR PERMIT 97-05 OTTIS' LANDING TOWN OF MOREHEAD CITY JANUARY 15, 2013 The Town of Morehead City was issued CAMA PERMIT 97-05 (Permit Class: TRANSFER) on June 9, 2010. The permit authorizes the re- construction of an existing building ( Ottis' Fish House and Restaurant building) located at 705/707 Shepard Street with the requirement the new reconstructed building was not to exceed the plan view footprint (based on drip -line of the structure) of the existing building (10,652 SF). Proposed construction included a 9,951 sq. ft. (Plan view) five story structure over a parking deck. Four of the five floors were designated for residential use with the fifth floor designated for commercial use. The proposed roof elevation was 64.9 ft. In addition to the five story building, docks and finger piers were proposed to create 10 boat slips at the rear of the proposed building. The residential units would be sold as condominium units. The boat slips would be for the benefit and use of the owners of the residential units. The Town is requesting modification of CAMA Permit 97 -05 to construct a project known as " Ottis' Landing". Work will be completed in three steps. Step 1 consists of the construction of a 12 ft wide "observation deck" (approximately 1,562 sq ft) parallel and adjacent to the existing concrete bulkhead. Step 1 work is expected to begin immediately following approval of the Town's application for modification by the Office of Coastal Management. Step 2 work includes the addition of approximately 5,871 sq ft of pavilion decking, known as Ottis' Landing, approximately 770 sq ft of public restrooms, and dock construction (1,072 sq ft) to accommodate ten boats. Step 3 involves construction of a roof over the Ottis' Landing pavilion area. The docks and 12 ft wide observation deck along the bulkhead will remain uncovered. There is not a well- defined time line for construction of Steps 2 and 3. The primary purposes of this request for CAMA permit modification are twofold. First, the Town desires' to construct the Step 1 improvements (12 ft wide observation deck along the concrete bulkhead) as quickly as possible following CAMA approval. Secondly, the Town desires the Permit to more accurately reflect the Town's longer term development plan including Steps 2 and 3 rather than the parking deck and five story building currently addressed by the CAMA permit. Dredging is not proposed as part of the project. Boats anticipated to use the proposed boat slips are anticipated to be relatively small "runabouts" or sailboats.
