On behalf of the Town of Apex Public Works and Utilities, Withers & Ravenel is requesting a
modification to the 404/401 permits issued for the Beaver Creek Gravity Sewer project in October
2012. Copies of the permits have been provided as Appendices. The proposed modification request
is the result of the realignment of the section of sewer from Kelly Road to the Kelly Road Pump
Station (Impact Exhibit 13). The sewer alignment had to be revised because a of a sewer connection
from a single family residence on the west side of Kelly Road that had not been previously identified.
In order to capture flow from this single family residence, the connection to the existing sewer line
had to be located fartherwest, resulting in the proposed realignment.
The proposed project is located in Apex, Wake County, North Carolina. The proposed sewer
alignment crosses Beaver Creek and its associated tributaries, which are located within the Cape
Fear /Jordan Lake Basin (HUC 03030002). The Water Quality Classification for Beaver Creek is: WS-
IV; NSW; CA and the Stream Index number is: 16- 41- 10 -(2).
Proposed Impacts
The revision to the alignment of the section of sewer from Kelly Road to the Kelly Road Pump Station
Impact Exhibit 13) has resulted in changes to impact totals for wetland and stream impacts. The
realignment of sewer line has resulted in a reduction of impacts for this section of the sewer line
shown on Impact Exhibit 13. A copy of the revised Impact Exhibits has been provided as an
Appendix.
The currently proposed impacts for the permit modification consists of 20 if of permanent stream
impacts, 177 if of temporary stream impacts, 5.479 acres of temporary wetland impacts 15,694 sq of
permanent buffer impacts and 8,302 sq ft of temporary buffer impacts. The project will also result in
1.1 acres of "permanent wetland conversion impacts ". The revised PCN has been provided as an
Appendix.

Mitigation
The previously issued permits required 1.1 acres of wetland mitigation for "permanent conversion"
impacts, 20 if of stream mitigation and 1,245 sq ft of buffer mitigation. The required mitigation has
been purchased and copies of the mitigation receipts have been provided as Appendices.
Please note that the proposed revision to the sewer alignment and subsequent impacts will not
result in additional impacts requiring mitigation. Therefore, no additional mitigation is proposed.
The current request is for 20 if of permanent impacts to jurisdictional streams, 177 if of temporary
stream impacts, ±5.479 acres of temporary wetland impacts, ±1.1 acres of permanent wetland
conversion impacts, 15,694 sq of permanent riparian buffer impacts and 8,302 sq ft of temporary
riparian buffer impacts (see the attached maps and PCN for details).

The proposed sewer alignment currently consists of undeveloped woodlands and existing cleared, maintained
easements. The general land use in the vicinity of the project consists of residential development.

The purpose of the proposed project is to expand the previously permitted Western Wake Beaver Creek Gravity Sewer, which
is part of the overall Western Wake Wastewater Management Facilities. The proposed Apex Beaver Creek Gravity Sewer will
capture sewage from the Hollands Crossing and Kelly Road Pump stations, which is currently being treated by Apex's Middle
Creek Wastewater Treatment Plant, and convey it to the Beaver Creek Pump Station and ultimately to the Western Wake
Wastewater Management Facilities. The purpose and need for this project is documented in Section 3 (Purpose and Need) of
the Record of Decision issued on July 21, 2010 for the Western Wake Wastewater Management Facilities. The complete

The proposed project consists of the construction of 12,000 If of gravity sewer ( ±5,800 If of 36" diameter sewer, ±5,600 If of
30" sewer, ±200 If of 12" sewer & 400 If of 8" sewer). The proposed sewer line will result in a 30' easement with a 10'
permanent access /maintenance corridor through wetlands and riparian buffers. The proposed sewer line will begin
approximately 200 If east of Kelly Road at the existing Kelly Road pump station (Latitude: 35.729394 °N; Longitude: -
78.893486 °W) and will flow in a southwest direction along Beaver Creek and will tie into the previously approved Western
Wake Beaver Creek Gravity Sewer line located approximately 500 If east of Richardson Road (Latitude: 35.720742 °;
Longitude: -78.923831'W) in Apex, Wake County, North Carolina. The Western Wake Beaver Creek Gravity Sewer was
approved as part of the Western Wake Regional Wastewater Management Facilities project (AID #SAW- 2005 - 20159; DWQ
Project #2006 - 1203).

The Corps of Engineers issued a Jurisdictional Determination on April 18, 2008 (AID# 2007 - 03763) for property owned by
the Town of Apex located adjacent to Beaver Creek. A copy of the signed JD has been provided as an Appendix.
Approximately 3,200 If of the proposed sewer line is located within this area. The wetlands within the additional sewer
alignment were flagged by W &R and JD information supporting the delineation has been provided as an Appendix.
The Corps of Engineers issued a Preliminary JD for the sewer alignment outside of the areas covered by the signed
wetland survey in conjunction with the issuance of the NWP 12 for the Town of Apex Beaver Creek Gravity Sewer project
(AID #SAW- 2005 - 20159)
Martin Richmond with NCDWQ issued a Buffer Determination Letter (NBRRO #12 -133) for the proposed sewer alignment
on August 21, 2012.

DWQ Project #2006 -1203) and is referenced in the Record of Decision issued on July 21, 2010.
The Apex Beaver Creek Gravity Sewer project was issued a NWP 12 (AID #SAW- 2005 - 20159) and a 401 WQC & Buffer
Authorization (DWQ Project #06 -1203, Ver.7) in October 2012, which are still valid.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Prior to final design of the proposed sewer alignment, a detailed wetland delineation was completed for a 200' wide corridor so
that impacts to wetlands and streams could be minimized. A preliminary review of the results of the wetland delineation was
conducted with the project engineers to identify environmental constraints (i.e. wetlands & streams), site constraints and

potential modifications to the alignment in order to minimize impacts. Following the review, the final alignment was designed
to avoid and minimize impacts to wetlands and streams when possible. However, due to the amount and location of the
wetlands and streams within the corridor, impacts could not be avoided completely (see attached Wetland Location Exhibit).
Several features and constraints, such as the location of Beaver Creek and existing development, dictated the location of the
final alignment. Specifically, the existing utility easement from Kelly Road to the Greenbrier subdivision was utilized for the
sewer alignment in order to minimize impacts to buffers, as well as minimize permanent wetland conversion impacts. Also,
the existing houses and pool within the Greenbrier subdivision and the existing houses within the Hollands Crossing
Subdivision prevented the sewer alignment from being located farther north, which resulted in wetland impacts (Wetland
Impact Exhibit 12a & 12b) and parallel encroachment into Beaver Creek's riparian buffers (Buffer Impact Exhibits 5 & 6).
Wetland impacts were minimized were minimized by designing the sewer alignment to cross the wetlands at the most narrow
point when practical.
The proposed stream crossings have been designed to cross the streams at perpendicular angles to minimize impacts to
streams and buffers. The proposed 20 If of permanent stream impacts will occur from construction of 10' If permanent rip -rap
crossings in two unnamed tributaries to provide a 10' wide permanent, stable crossing for vehicles and equipment for future
monitoring and maintenance. The proposed permanent stream crossings will be constructed so that the top of the rip -rap will
match the natural grade of the stream bed and banks to prevent impeding flow, allowing passage of aquatic life and
preventing impoundment of water upstream during periods of low flow. Please note that the 10' permanent stream crossing
will only be constructed and utilized after the completion of construction of the sewer line. During construction, logging mats
will be used to span the creek to provide equipment access during construction in order to minimize disturbance to the
streams.
Permanent stream impacts have been minimized by restricting the construction of permanent stream crossings to the
unnamed tributaries. Permanent stream crossings are not proposed within Beaver Creek.
Upon completion of the installation of the proposed sewer line, the disturbed wetland areas will be returned to natural grade
and seeded with a wetland seed mix to restore wetland vegetation. The seeding will consist of a mixture of native species as
specified on Sheet D -6 of the Sediment and Erosion Control Plans, which has been provided as an Appendix. Only the 10'
permanent access /maintenance corridor will be regularly mowed, and the remainder of the restored wetlands will be left
undisturbed.

Stream crossings were designed to cross streams and buffers at as close to perpendicular as possible. Also, existing utility
easements were utilized when available. Silt fencing will be installed around all disturbed areas to prevent sediment from

covered by General Water Quality Certification Number(s) 3884 (GC3884). The Certification(s) allows
you to use Nationwide Permit(s) NW 12 when issued by the US Army Corps of Engineers (USACE). In
addition, you should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non -
discharge, and other regulations.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify as and you may be required to send us a new application. If the property is sold,

Sediment and Erosion Control:
2. Erosion and sediment control practices must be in full compliance with all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor -owned or leased borrow pits associated with the project.
c. Sufficient materials required for stabilization and /or repair of erosion control measures and
stormwater routing and treatment shall be on site at all times.
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the 404/401 Permit Application. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control.Best
Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur;
4. Sediment and erosion control measures shall not be placed in wetlands or waters without prior approval
from the Division. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, design and placement of temporary erosion control measures shall not be conducted in a
manner that may result in dis- equilibrium of wetlands or stream beds or banks, adjacent to or upstream
and down stream of the above structures. All sediment and erosion control devices shall be removed
-and the natural grade-restored within two (2) months of the date that the Division of Land Resources -or-
locally delegated program has released the project;
5. Protective Fencing - The outside buffer, wetland or water boundary and along the construction corridor
within these boundaries approved under this authorization shall be clearly marked with orange warning
fencing (or similar high visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15 NCAC 2H,
Section .0500;

6. Construction Stormwater Permit NCG010000
An NPDES Construction Stormwater Permit is required for construction projects that disturb one
(1) or more acres of land. This Permit allows stormwater to be discharged during land disturbing
construction activities as stipulated in the conditions of the permit. If your project is covered by
this permit, full compliance with permit conditions including the erosion & sedimentation control
plan, inspections and maintenance, self - monitoring, record keeping and reporting requirements is
required. A copy of the general permit (NCGO 10000), inspection log sheets, and other

7. Mitigation:
Mitigation must be provided for the proposed impacts as specified in the table below. We
understand that you wish to make a payment to Restoration Systems, LLC (RS) to meet the
stream mitigation requirement and to the NC Ecosystem Enhancement Program (EEP) to meet
the buffer mitigation requirement. These methods have been determined by the DIVISION to be
a suitable methods to meet the mitigation requirements. Until the RS and EEP receive and clear
your check (made payable to: Restoration Systems, LLC and DENR — Ecosystem Enhancement
Program Office), no impacts specified in this Authorization Certificate shall occur. RS should be
contacted at (919)- 334 -9119 and the EEP should be contacted at (919) 716 -1921 if you have any
questions concerning payment into a bank or restoration fund. You have 60 days from the date of
this approval to make this payment. For accounting purposes, this Authorization Certificate

8. Diffuse Flow
All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at
non - erosive velocities through the protected stream buffers such that it will not re- concentrate before
discharging into a stream as identified within 15A NCAC 2B .0267 (5). If this is not possible, it may
be necessary to provide stormwater facilities. This may require additional approval from the Division.

Buffer Rules, and any subsequent modifications, the applicant is required to return the attached

by Buyer to satisfy the compensatory mitigation requirements established by the Permit and
Certification (the Compensatory Mitigation Requirements) and that upon the presentation
of this signed Transfer Certificate by RS to Buyer, and the delivery to CORPS /DWQ a copy
of this Certificate of Transfer along with an Official Credit Ledger and the COPS'
Compensatory Mitigation Responsibility Transfer Form, that all obligations with respect to
the Compensatory Mitigation Requirements, shall be the sole responsibility of RS.
2. RS acknowledges that Buyer has made full payment to the Cripple Creek Mitigation Bank
and agrees to fulfill the Compensatory Mitigation Obligations.
3. Upon execution of this Agreement, RS shall forward an original of same to CORPS and
DWQ.
4. RS certifies that mitigation credits are immediately available to Buyer and that all
conditions relating to providing the transferred of mitigation obligation outlined in Buyer's
Permit Action.
