I have reviewed the following:
Devils Racetrack 12 -0747 Note: This is the correct project number. The application was erroneously assigned 13 -0127
when the project already had a number assigned during the IRT review of the draft mitigation plan.
Byrds Creek 12 -0102
Both mitigation plans reflect the comments, discussions and recommended changes that came up during IRT review of
the draft mitigation plans. I have no further comments. Feel free to issue both after your review if you have no issues or
concerns. Feel free to contact me if you have any questions.
Please ensure the following additional condition is added to these and all future mitigation project 401s
Mitigation Credit
Approval of the restoration plan and issuance of the 401 Water Quality Certification means that DWQ has determined
that the proposed activity will not remove or degrade significant existing uses of the surface water (15A NCAC 2H
.0506(a)). The issuance does not represent an approval of credit yield for the project.
