In addition, I do have a number of photos of the lot if BLR ARB or Duke Energy asks for them.
I didn't think that may be necessary since the lot has already been inspected. But, if either one needs photos for their
records, I can do that for you.

You have it right. No gravel down the logging road as that will be covered by the home site in the future.
I will mail to you today, the BLR ARB application and fee and the deposit for the work.
In regards to the shoreline, Kevin was going to talk to you this weekend. Once I get his acceptance, I will mail to you the
various applications and fees and my expectation for the work.

Hi, I hope you had a good weekend. Everything looks good as far as the project scope. I'm having a problem with my
printer, so I will attempt to give you a better understanding of what I think is your expectation of the gravel portion of the
drive. The area where the trees near the property line are going to be removed and we have been calling the switch back,
is where I planned on making wider for a parking place and turn around. Which will also serve the same purpose when
the home is constructed. I can extend the gravel down to the dock area if you wish, but that would require 3 -4 more loads
of gravel. I thought you had said you wanted access to the very bottom via. golf cart or rec. vehicle, but not an actual
gravel drive. Let me know if I have this wrong, I just want to make sure I give you what you want. My mailing address is

In regards to the extension of gravel on the driveway and the car turn - around location — I think that it would be
better for you to illustrate on the attached "lot topo" what you have in mind so that we have a clearer
understanding of the expectations.

Hi, Everything looks good in your scope of the project. I have one clarification I need from you for the driveway. Are you
calling the switch back area, the turn around (future home)? That is the area I anticipated the gravel ending, and using the
existing road to the dock as access, but no gravel. As far as your questions, I will look at the possibility of burying the
culvert to ensure no water is trapped. Either way, I will assure that no water will be trapped. The hydroseeding is an extra
cost, mostly materials. I did talk with Brandon today and per our conversation I believe everything will go smoothly. I
offered to meet with the members of the board to flag or located our intentions. Have a good night and thank you again,

Thank you for your comments. I have attached a revision of my expectations (ie. contract) based upon your
feedback. I have only a couple of remaining questions in yellow. Please respond at your convenience and
please comment if I have it right or where corrections need to be made.
I hope that sections of this document can be used for the BLR ARB approval process.
Once agreed upon, I will send you a deposit and you can make your plans to meet with Brandon.

Hi, I hope all is well. Maybe I'll get some sleep tomorrow night! Here are the answers to your questions and concerns.
First of all, you are headed in the right direction with seeking BLR approval. We can stack firewood at your specified
location. We can save locust trees for fencing, other types are not as hard and will rot. I can do a boulder curb. I will find
out about the utility relocates. Any fill or cut bank will need hydroseeding. I will fix any erosion or compaction problem for
one year at no charge, but I can't warranty land slides or surface sinking. This is due to my lack of knowledge of what
material is already under the existing road. I will stand behind any work that I do and will do the job right the first time. It
will take approximately 5 loads of gravel and 10 or less loads of extra soil. This is due to the use of existing soil on site.
Placing gravel will help with future construction and asphalt requires a 4 -6 inch base of gravel. You can add $500.00 for
all of the additional work and boulders are included in that price. The hydroseeding is $750.00 per load and I have a large
seeder, which will cover all your banks in one load. I typically ask for half of the known cost, to initiate the project. Let me

4.18 Lake Walls
The zone at which the water meets the dry land, the lake edge, is a dynamic band in the
landscape that serves many ecological functions including providing habitat for a wide variety of
plants and animals.
Further, the lake edge is a highly visible landscape element that is important to the way Bear
Creek Lake is experienced from the water. In order to preserve the ecological integrity and
natural visual appeal of the lake edge, lake walls are highly discouraged. The Owner must
obtain written approval from the ARB for the design and construction of lake walls. Generally,
the design and construction of lake walls will be considered by the ARB for lake edge
stabilization only as a last resort in situations with extreme circumstances. The Owner is
required to provide documentation of the extreme conditions that require a wall as opposed to
more natural methods of stabilization. In addition to approval from the ARB, the Owner is
responsible for obtaining approval from Duke Power Lake Management, Jackson County and
any other required jurisdictional governmental permits. Duke Power has adopted the Duke
Power Nantahala Area Shoreline Management Guidelines with which any improvements and
other activities within the shoreline must comply.
If the ARB determines that the conditions require a lake wall, the wall will be reviewed for both
form and function. Lake walls must be structurally sound (designed by an engineer) and natural
in appearance. Boulders or other natural stones utilized for wall facing is preferred, with a high
priority placed on consistency with adjacent structures. Additionally, lake walls must be
maintained in good condition and repair by the Owner of the homesite.
