Association, have submitted a request to modify CAMA Major Permit No. 129-10, which was originally
issued on November 1, 2010, and later renewed, modified and transferred. The permit was recently
modified on June 2, 2020, and is scheduled to expire on March 1, 2025.
The permittee is requesting approval to re -configure a portion of the existing marina docking facility
(within the basin) as well as the ten -slip docking facility located along Banks Channel. The total
combined slip count within the two canal system (northern and southern canals) is permitted at 38 total
slips.
As proposed, the permitted ten -slip docking facility located along Banks Channel (which has not yet been
constructed) would be modified to accommodate eight vessels, instead of ten. As part of the re-
configuration, the main dock spine would be shifted back in a landward direction a distance of 5', to
accommodate a 5' extension of the finger piers. Currently, the five finger piers are authorized at a length
of 25' and the current proposal would extend the finger piers to 30' in length, with the width remaining
the same. The permittees propose to eliminate one of the finger piers, reducing the total slip count to
eight. In summary, the overall footprint of the Banks Channel dock would remain consistent with that
permitted, with a reduction in slips count at this location. See Exhibit C for final configuration of the
Banks Channel dock.
Within the northern canal, the permittee is proposing to add slip No. 26 along the outer edge of the
northern most finger pier (slips 17-25) as shown on Exhibit B. Previously, the outer edge of the existing
dock (proposed as slip no. 26), has not been considered a slip.
Lastly, the applicant is proposing to add two, 8' x 8' drive -on floating jet ski lifts within the marina basin,
both of which would be located along the eastern shoreline, between the bulkhead and the existing
docking facility. Based on current Rule language, the two jet ski lifts, labeled IA and IB, would not result
in an increase in slip count as they would be considered platform area.

Through this re -allocation and re -configuration, the total number of slips within the marina as a whole,
would be reduced from 38 to 36. The permittee has requested that Exhibits A-C be used for slip
designation, as they are planning to record these slips (configuration and number) with Pender Co.
Based on the information provided, regarding the minor modification request (plans and documents),
there does not appear to be any impacts to any wetlands, and the size/footprint of the development plan
would remain consistent with DCM's Rules concerning the Estuarine Shoreline and Public Trust AECs.
At this time, this office has no objection(s) to this renewal request. The applicant has submitted a check
(No. 10673) in the amount of $100 to cover the processing fee.
By copy of this memo, DCM is requesting that the NC Shellfish Sanitation Section and NCDEMLR - provide
any comments that your agency may have on the proposed project to Curt Wychert of DCM's Morehead City
office within 14 days of receipt of this memo

AGREEMENT REGARDING CAMA PERMIT
This Agreement Regarding CAMA Permit 129-10 is made and entered this 13Eh day of
December, 2019, by- and between the Queens Grant Recreational Association, Inc. ('QGRA")
and The Marina at Items Grant ("The Marina") and is as follows.
WHEREAS, The Marina is the fee owner Tract X and Tract XIII described on a map recorded in
Map Bookol, Page 43 of the. Pender County Registry ("Marina Property");
WHEREAS, QGRA is the fee owner of Tract VII and Tract VIII as shown in Map Book 55, page
81 and 82 of the Pender Count Registry and Tract LX as shown in Map Book 61, Page 43 of the
Pender County Registry (collectively "QGRA Property");
WHEREA.S, the Marina Property and the QGRA Property are riparian in nature and are covered
by a permit issued by the North Carolina Division of Coastal Management under the Coastal
Area Management Act, permit number 129-10 ("the CAMA Permit'); and
WHEREAS, The Marina and the QGRA desire to enter this Agreement in order to add QGRA as
a party to the CAMA Permit and to define each party's obligations to maintain the properties
covered by the CAMA Permit.
NOWTHEREFORE„ QGRA and The Marina Ihereby acknowledge that the mutual covenants and
obligations exchanged herein are material and valuable and are as. follows:
1, Maintenance. QGRA shall be responsible for maintaining. the QGRA Property and the
associated riparian installations (including without limitation, docks, piers and other
attachments to the QGRA. Property, as well as dredging within the associated riparian
corridors and as required by the CAMA Permit. The. Marina shall be responsible for
maintaining The Marina Property and the associate riparian installations (including
without limitation, docks. piers and other attachments to The Marina Property, as well as
dredging within the associated riparian corridors and as required by the CAMA Permit.
1. The CAMA Permit. QGRA shall execute such documents as are necessary to have
QGRA added as a perinitee under the CAMA Permit.
3. Indemnificatiom QGRA shall indemnify The Marina, and The Marina shall indemnify
QGRA, from any cost associated with a Failure to abide by their respective obligations in
Section 1, above, "Any cost" shall include, without limitation, any expense incurred by
The Marina or QGRA in order to comply with the CAMA Permit, but which expense is
incurred to maintain, improve or modi the other's property, atter reasonable notice and
opportunity for The Marina and QGRA to maintain, improve or modify their own
property.
