Activities that are eligible for US Army Corps of Engineers Nationwide Permit 29, but that are not eligible for coverage
under General Water Quality Certification 4256, which became effective March 15, 2021, require an Individual
Certification. Per Title 15A NCAC 02H .0503(b), a public notice must be issued for pending applications for Individual
certifications. A public notice was issued for the subject project on April 16, 2021, and the public comment period
concludes May 17, 2021. 1 cannot take action on the application until the public comment period ends. I will place the
project on hold until the public comment period concludes.
