However, we have not received the final design of the dissipator pad. As to your request for NCDOT's response regarding your review of their design, they have made no response. When we receive a copy of the design, I will forward the design to you for your records. However, the review and approval process of the design is NCDWQ's responsibility. You may provide comments to us regarding the design, but ultimately we will approve a design that satisfies our regulations regarding the Randleman Buffer Rules. Any further actions you feel are necessary regarding the damage to your property will have to be resolved via NCDOT's tort claim process. If you have additional questions, please let me know. thanks. Could you please let me know what NCDOT's response was to your request? Thank you. Also in my December 20, 2011 email to you, I requested that DWQ provide me a with a copy of the proposed final design of the outlet protection repair before DWQ provides its comment(s) and /or approval to NCDOT so that I can provide comments to DWQ before DWQ takes any final action on the proposed final design. I am certainly pleased that DWQ will maintain review and approval control over NCDOT's final design. And, while I can understand that DWQ has no authority to require NCDOT to allow me to review the dissipater design, I hereby pecifically request that DWQ provide me with a copy of proposed final design BEFORE DWQ provides its comment(s) and /or approval so that I may have an opportunity to review it with my advisors and provide any comment(s) to, DWQ before DWQ takes any final action with respect to the proposed final design. It seems absolutely unconscionable to me to think that the property owner whose property is clearly most vulnerable to damage by NCDOT's outlet protection is not being given an opportunity by NCDOT to review their proposed repair! I also specifically request that you provide me with NCDOT's response to your request that I be given an opportunity by NCDOT to comment on it. I am also pleased to see that you confirm DWQ's position that the drainage pipe outlet protection is and was subject to the Randleman buffer rules. I cannot fault your desire to focus efforts on bringing the outlet into compliance, etc. rather than to continue to debate the point with NCDOT. I will take care of contesting NCDOT's unfounded position as I pursue other action against NCDOT. Hilary Rauch
